Abstract:

Cílem této práce je objasnění problematiky opatření obecné povahy a to ve vztahu k otázkám, co je možné považovat za opatření obecné povahy, jaké jsou jeho hlavní znaky, za jakých podmínek lze tento institut v rámci veřejné správy využít. Hlavní část práce, který je věnován rešerši a analýze judikatury Nejvyššího správního soudu a Ústavního soudu týkající se institutu opatření obecné povahy, je rozdělen na dva oddíly. V prvním je řešena otázka, co lze za opatření obecné povahy dle judikatury považovat, jakým stylem probíhá argumentace soudů v případě pochybností, zda se opravdu jedná o tento institut, jestli jsou upřednostňovány znaky formální nebo materiální, případně jejich kombinace. Z rešerše judikatury je patrné, že soudy při posouzení opatření obecné povahy spíše preferují materiální hledisko před hlediskem formálním. Základem argumentace je vždy posouzení materiálních znaků a to konkrétně určeného předmětu a obecně vymezeného počtu adresátů a to i v případě, že je posuzovaný akt ve speciálním zákoně označen jako opatření obecné povahy, absence materiálních znaků totiž vždy vede ke zrušení opatření obecné povahy. Naopak je možné, že pokud formálně neoznačený akt splňuje materiální hlediska, je označen jako opatření obecné povahy. V druhé části je nastíněn možný vývoj, kterým se může ubírat posuzování tohoto instutu. Ze samotné podstaty věci se nabízí dvě možnosti, jedna vede k tomu, že opatřením obecné povahy budou označovány i akty, které takto v zákonné úpravě nazývány nejsou, druhá cesta vede přes zákonodárce, kteří legislativu upraví tak, aby vyhovovala formálním hlediskům při posuzování institutu opatření obecné povahy. Materiální pojetí klade větší důraz na právní ochranu jednotlivce a možnost jeho ochrany ve správním soudnictví, a v neposlední řadě i na subsidiaritu ústavní ochrany, kterou mají poskytovat především správní soudy. Na druhou stranu by to vedlo k menší právní jistotě a menší předvídatelnosti práva. Velmi pozitivní by naopak při preferenci materiálního pojetí bylo nalézání právní ochrany v případech, ve kterých do té doby prakticky žádná ochrana nebyla. Naopak pokud by převládlo formální pojetí opatření obecné povahy, tedy že by se tento typ právního aktu vyskytoval pouze v zákonem výslovně uvedených případech, pak by opatření obecné povahy v českém právním řádu existovala pouze ve zvláštních zákonech. Formální pojetí opatření obecné povahy by svědčilo větší právní jistotě a větší předvídatelnosti jednání veřejné správy.

Abstract:

The aim of this paper is to clarify the problematic area of general administrative measures in the relation to the questions of the characteristics and the conditions of using this instrument in the practice. The main part of this paper deals with background research and analysis of the judicature of the Supreme Administration Court and Constitutional Court. First question which I try to solve if what can we consider as the general administrative measure according to the judicature, what arguments are used by the court when there are doubts about it, whether it is really this institute, whether they prefer formal or material characteristics of their combination. In the judicature background research we can find that the mentioned courts prefer material point of view more than the formal. The base of the argumentation is to judge the material characteristics concretely the object, the subjects also in the case when the judged act is the special law named ad general administrative measures. The absence of the material characteristics leads to the abolition of the act. On the other side it is possible that when the act is formally named differently but it has the material characteristics it is considered as the general administrative measures. In the second part the possible development of this institute is outlined. From the base of that there are two possibilities, one leads to the fact that as the general administrative measure we consider also the acts which are not named this way in the law, the second way leads through the legislator, who will change the legislation that it will be in accord to the formal materials of this institute. The material point of view gives the importance to the legal protection of individuals and the possibility to protect him before the administrative courts and at last but at least the subsidiary constitutional protection with shall be used by the administrative courts. On the other side this will leads to the lower legal sureness and lower prediction of the law. As very positive I consider the preference of the material view by looking for the legal protection in the cases when there was no protection at all. On the contrary whether the formal view of the general administrative measure will be preferred, that means that this type of the legal act will be only in the law strictly expressed cases, than the general administrative measure will exist only in the special laws. The formal point of view rises up the legal sureness and preciseness of the law in the public administration. The most useful resolution will be in the case that the formal and material point of view of this institute will be used in the same time to support. Nowadays the judicature and also the literature is not uniform in the question whether we prefer material or formal characteristics of the general administrative measure.
