Uniqueness as a Conceptual Feature of a Copyrighted Work

Abstract:

Práce po základním nástinu problematiky práva duševního vlastnictví, práva autorského a definování samotného autorského díla – skrze dílčí pojmové znaky – charakterizuje znak nejproblémovější, a to jedinečnost. Práce nabízí výklad tohoto znaku z pohledu filosofického i právního, zasazuje jej do historického i globálního kontextu a vymezuje jeho vztah ke znaku původnosti coby nižšího požadavku na míru tvůrčí činnosti a originality ve smyslu práva Evropské unie. Dále práce předkládá základní přehled soudních rozhodnutí v otázce jedinečnosti na národní i unijní úrovni a analýzu jedinečnosti v případě vybraných druhů děl, kde právě tento znak hraje klíčovou roli, jakož i modelovou situaci střetu dvou jedinečných děl a její možné řešení.

Abstract:

Based on outline of the intellectual property law problematics as well as the copyright and defining the copyrighted work itself – with the help of all of the conceptual features – this thesis focuses on the most problematic feature, the uniqueness. This thesis contains interpretation of this character from the philosophical and legal perspective, puts it in the historical and global context and defines its relations to the character of originality as the lower requirement in sense of level of creativity and in sense of law of the European union. Moreover, this thesis presents basic overview of national and CJEU judicial decisions and its analysis in the special forms of works, where uniqueness plays the key role, as well as the model situation of the conflict between two unique works and its possible solution.
