Leninency Programme in Competition Law

Abstract:

Cílem této práce je představit koncept programu shovívavosti (leniency), popsat jeho vývoj a současnou právní úpravu v USA a v Evropském Společenství, zabývat se jeho vztahem k soukromoprávnímu vymáhání práva a představit de lege ferenda myšlenky ohledně budoucího vývoje programů shovívavosti. Práce začíná definováním podstaty programu shovívavosti, jeho základní vývojem v první zemi, kde byl aplikován (USA), a také charakterizuje základní rysy úspěšného programu shovívavosti. Jsou rozebrány typy a formy ukládání správních a trestních sankcí, následované zamyšlením nad právními následky beztrestnosti porušitele práva. Práce podrobněji rozebírá vývoj programu shovívavosti v Evropském Společenství, zdůrazněn je přitom pokrok v oblasti klíčových součástí programu směrem k efektivnějšímu, transparentnějšímu a atraktivnějšímu systému, přičemž je poukázáno na některé základní rozdíly mezi programem shovívavosti v USA a ES. Vedle toho je analyzováno soukromoprávní vymáhání antimonopolního práva jako doplňující element k veřejnoprávnímu vymáhání prostřednictvím Evropské komise a národních antimonopolních úřadů členských států ES. Vývoj v této oblasti je rozebrán společně s iniciativami Komise k postupné harmonizaci soukromoprávních řízení v rámci ES. Další části práce se zabývají programem shovívavosti, jak je uplatňován v České republice a ve Velké Británii, přičemž jsou zdůrazněny klíčové shody a rozdíly. Stručně jsou také nastíněny programy shovívavosti v ostatních členských státech ES. V závěru práce jsou shrnuty de lege ferenda myšlenky ohledně budoucího vývoje programů shovívavosti jak uvnitř Společenství (harmonizace, zvýšení rychlosti a efektivnosti, „amnesty a leniency plus“), tak vně prostřednictvím celosvětové konvergence těchto programů.

Abstract:

The aim of this thesis is to introduce the concept of the leniency programme, describe its development and current legal regulation in the U.S. and European Community, address its relation to private enforcement and present de lege ferenda thoughts for future development of leniency programmes. The thesis commences with defining what is a leniency programme, its basic evolution in the first country of application (U.S.) and the key features of a successful leniency programme. The types and forms of imposing administrative and criminal sanctions are discussed as well as the reflection on the legal consequences of providing immunity from sanctions to antitrust law infringers. Furthermore, the thesis deals with the development of leniency programme in the EC, highlighting the progress in key constituents towards a more effective, transparent and attractive system, and some key differences between the EC and U.S. leniency programmes are stressed out. Also the private enforcement is analyzed as a complementary element to the EC antitrust law public enforcement by the Commission and competition authorities of EC member states. The development is demonstrated on the Commission’s initiatives to harmonize the private enforcement procedures within the EC. Next sections deal with leniency programmes in the Czech Republic and the UK, highlighting some key similarities and differences, while leniency programmes in other EC member states are briefly outlined as well. Finally, the de lege ferenda chapter summarizes ideas for future development of leniency programmes both internally in the EC (harmonization, increase in speed and effectiveness, amnesty and leniency plus) and externally in the worldwide convergence of leniency policies.
