Right on legal protection and due process in the civil proceedings

Abstract:

Cílem bakalářské práce bylo zpracovat téma: „Právo na soudní ochranu a spravedlivý proces v civilním procesu“ z pohledu ústavněprávních záruk a zásad civilního procesu. V práci jsem se pokusil o rozbor problematiky ústavních principů soudní ochrany, dílčích aspektů práva na soudní ochranu podle občanského soudního řádu a způsobů ochrany práva v civilním řízení. Právo na soudní ochranu a spravedlivý proces je jedním ze základních lidských práv. Docílit naplnění těchto práv lze jen v právních a demokratických zemích. Dobrým garantem těchto práv jsou ústavní zákony České republiky a mezinárodněprávní ochrana těchto práv. Ústavní soud České republiky se stal respektovanou institucí. Do budoucna, usuzuji, je třeba ještě více posílit jeho autoritu. Domnívám se, že je možno zvážit i zakotvení ústavního postavení veřejného ochránce práv. Mám za to, že problematika lidských práv se v budoucnu ještě více posune do oblasti práva. Dále soudím, že se musí zvýšit nároky na procesní aktivitu soudu v podobě vysvětlovací, dotazovací a poučovací povinnosti soudu. Domnívám se, že důsledné budování občanské společnosti demokratického právního státu se pozitivně promítne i do oblasti práva na soudní ochranu a spravedlivého procesu v civilním procesu.

Abstract:

Abstract The aim of the bachelor thesis is to deal with the theme “The right to judicial protection and the just legal trial in the civil proceedings” from the point of view of constitutional juridical guaranties and principles of the civil proceedings. In the thesis I have attempted to analyse the problem of constitutional principles of judicial protection, partial aspects of the right to judicial protection based on Civil Procedure Act and the way of legal protection in the civil proceedings. The right to judicial protection and the just legal trial is one of the basic human rights. To achieve fulfilling of these rights is possible only in judicial and democratic countries. Constitutional laws of the Czech Republic and international legal protection of these rights are good guarantees of these rights. The Constitutional Court of the Czech Republic has become a respected institution. I assume for the future that it is necessary to strengthen even more its authority. I suppose that it is possible to consider even integrating of the constitutional position of the public guardian of rights. I assume that the problem of human rights will be shifted even more to the sphere of law in future. I also suppose that there must also be increased claims on procedural activity of courts in the way of explaining, enquiring and indoctrinating. I expect that consistent building of the civil society of the democratic legally consistent state will reflect positively also in the sphere of the right to judicial protection and the just legal trial in the civil proceedings.
