The development of legislation on jurisdiction agreements in relations with an international element in the European judicial area in the light of the revision of the Brussels I Regulation

Abstract:

Předložené práce se zabývá problematikou vývoje právní úpravy dohod o volbě soudu ve vztazích s mezinárodním prvkem v evropském justičním prostoru. První kapitola práce je věnována teoretickému vymezení prorogačních dohod včetně jejich charakteristiky, základního členění a vymezení doktrín, které jsou s nimi spojeny. Druhá kapitola práce se zabývá analýzou historického vývoje evropského justičního prostoru, která je nezbytná pro celkové uchopení tématu práce. Třetí kapitola práce je věnována analýze prorogačních dohod v Bruselské úmluvě z roku 1968, která je předchůdcem současné právní úpravy. Nejvýznamnější kapitola práce obsahuje analýzu právní úpravy prorogačních dohod obsaženou v nařízení Brusel I, a to včetně rozboru relevantní judikatury Soudního dvora Evropské unie. Pátá část práce je věnována procesu revize nařízení Brusel I, a to od představení Zelené knihy a Zprávy Komise v roce 2009 až po přijetí finální verze nařízení Brusel Ia v roce 2012. Součástí předložené práce je také rozbor prorogačních dohod v nejvýznamnějších mezinárodních smlouvách platných v evropském justičním prostoru, a to Luganské úmluvě z roku 1998 a 2007 a v Haagské úmluvě z roku 2005. Pro úplnost je v práci zařazen také rozbor situací, v nichž se na prorogační dohody aplikuje vnitrostátní úprava českého právního řádu.

Abstract:

Presented thesis is concerned with the development of the legislation on jurisdiction agreements in relations with international element in the European judicial area. The first chapter is devoted to the theoretical definition of jurisdiction agreements including their characteristics, classification and doctrines that are associated with them. The second chapter deals with an analysis of the historical development of the European judicial area, which is essential for overall understanding of theme of the thesis. The third chapter is devoted to analysis of jurisdiction agreements in the Brussels Convention of 1968 which is the predecessor to the current legislation. The most significant chapter of the thesis is concerned with the analysis of jurisdiction agreements contained in the Brussels I Regulation including analysis of relevant case law of the Court of Justice of the European Union. The fifth chapter is devoted to the process of revision of the Brussels I Regulation initiated with the presentation of the Green Paper and the Commission Report in 2009 and finalised by the adoption of the final version of the Brussels Ia Regulation in 2012. Presented thesis also contains the analysis of jurisdiction agreements in the most important international treaties valid in the European judicial area - in the Lugano Conventions of 1998 and 2007 and Hague Convention of 2005. For completeness, the thesis also deals with the cases where applies national legislation of the Czech Republic.
