Termination of an apartment lease

Abstract:

Diplomová práce se zabývá skončením nájmu bytu. Práce je rozdělena do tří hlavních kapitol. Nejprve je proveden historický exkurz, v rámci kterého je pojednáno o právní úpravě skončení nájmu bytu v zákoně č. 40/1964 Sb., občanský zákoník. Dále je v práci podrobně rozebrána aktuálně účinná úprava této problematiky obsažená v zákoně č. 89/2012 Sb., občanský zákoník. Poslední část práce je zaměřena na právní úpravu skončení nájmu bytu v kanadské provincii Ontario. Ve všech částech práce je pojednáno o právech a povinnostech pronajímatele a nájemce, která těmto stranám nájemního vztahu v souvislosti se skončením nájmu bytu vznikají.

Abstract:

The thesis focuses on the termination of an apartment lease. The thesis is divided into three main chapters. First, a historical excursion is made, in which the legal regulation of the termination of the lease of an apartment in Act No. 40/1964 Coll., Civil Code, is discussed. Next, the thesis discusses in detail the currently effective regulation of this issue contained in Act No. 89/2012 Coll., Civil Code. The last part of the thesis focuses on the legal regulation of the termination of an apartment lease in the Canadian province of Ontario. All parts of the thesis deal with the rights and obligations of the landlord and tenant that arise for these parties to the tenancy relationship in connection with the termination of an apartment lease.
