Common Customs Tariff and the Procedure of Tariff Classification

Abstract:

Bakalářská práce je zaměřena na aplikaci společného celního sazebníku při výkonu celního práva. Po krátkém ohlédnutí do historie celních sazebníků na našem území následuje rozbor základního právního předpisu pro uplatňování celně sazebního systému Společenství upravujících obchod se zbožím nebo jejich statistiku. Dále je podrobněji popsán základ tohoto předpisu, kterým je celní nomenklatura. Stěžejní část práce se věnuje procesu sazebního zařazení zboží, který vede k vyměření celního dluhu a je též nezbytný pro správnou a cílenou aplikaci celé řady netarifních opatření. Pozornost je zaměřena zejména na základní zásady a všeobecná výkladová pravidla. V další části práce je věnován prostor pro celním kodexem ustanovený institut závazných informací o sazebním zařazení zboží a následuje i krátké pojednání o odpovědnosti za správné sazební zařazení zboží. Práce je doplněna o příklady z aplikační praxe s využitím adekvátní judikatury.

Abstract:

This bachelor´s thesis is focused on the application of the Common customs tariff within the administration of the customs law. First of all, there is a short hindsight at customs tariffs in our territory and after that follows analysis of the basic rule of law for exercise of the Community customs tariff system which regulates the trade in goods and their statistics. Afterwards, there is described in more detail the basis of this rule of law and that is the customs nomenclature. The fundamental part of the thesis is focused on the process of the tariff classification of goods. This classification leads to the assessment of the customs debt and is necessary also for the correct application of many nontariff measures. The attention is paid especially to the basic tariff principles and general interpretative rules. The next part deals with the legal instrument called "binding tariff information" which has its legal basis in Community Customs Code and after that follows short treatise on responsibility for correct tariff classification of goods. The thesis is supplemented by several examples from application practice using appropriate judicature.
