Domestic violence: current legal regulation, effect on the development of children and the society's help to its victims

Abstract:

Cílem této bakalářské práce je podat ucelený přehled o současné právní úpravě domácího násilí z pohledu legislativy České republiky, popsat vliv domácího násilí na budoucí vývoj dítěte a zmapovat pomoc společnosti obětem domácího násilí. Úvod práce je věnován základní charakteristice pojmu domácí násilí, jeho podobám a kritériím pro jeho určení. V další části jsou uvedeny právní dokumenty, které byly přijaty OSN či Radou Evropy a zmapován je i současný právní stav problematiky v České republice. Jsou zde také doplněny příklady právní ochrany před domácím násilím v některých evropských státech. Kapitola tři popisuje vliv domácího násilí na vývoj a budoucí život dítěte, a také mapuje právní možnosti ochrany dětí před tímto násilím. V závěrečné kapitole je zachycen vývoj postojů společnosti k tomuto jevu a je zde uvedena i důležitá role nestátních organizací, které v současné době poskytují specializovanou pomoc jeho obětem. Poslední část bakalářské práce se věnuje poslaneckému návrhu novely zákonů souvisejících s domácím násilím, která by měl přinést zlepšení právní ochrany jeho obětem.

Abstract:

The sense of this bachelor work is to give the integrated overview of the temporary legal adjustment of domestic violence from the view of the Czech Republic legislative, to describe the influence of domestic violence on the future child{\crq}s development and to map out the help to the victims of domestic violence. The exordium of the work is given to the basic definitions characterising the domestic violence, its forms and criterion for its assignation. In the next part, there are named legal documents accepted by United Nations or COE and the temporary legal situation of the problems in the Czech Republic is charted here as well. There are also eked the examples of the legal defence against domestic violence in some European countries. The Chapter III describes the influence of domestic violence on child{\crq}s development and his future life and also maps out the possibilities of children legal protection from this violence. The final Chapter shows the development of the society attitude towards this event and it also indicates very important role of independent organisations that in the present era provide the specialized help to the victims of the violence. The last part of the bachelor work attends to the parliamentary proposal of the amendment of acts that are connected with domestic violence. This amendment should bring improvement of legal protection to the victims.
