Regulation of Religious Symbols at the Workplace

Abstract:

Tématem diplomové práce je regulace náboženských symbolů na pracovišti. První část této práce má za úkol definovat základní pojmy pro potřeby této práce, například náboženství nebo náboženské symboly. Ve druhé části poté dojde k výběru některých rozhodnutí SDEU a ESLP, které budou blíže rozebrány, a ze kterých budou vyvozeny limity, kterým se zaměstnavatel při regulování náboženských symbolů na pracovišti musí podřídit. Cílem práce je shrnout právě tyto limity, které zaměstnavateli z rozhodnutí vyplývají, a kterými se při omezování náboženských symbolů na pracovišti musí podřídit.

Abstract:

The topic of the thesis is the regulation of religious symbols in the workplace. The first part of this thesis is to define basic terms for the purpose of this thesis, for example religion or religious symbols. The second part will then select some CJEU and ECHR decisions that will be discussed in more detail, and from which will be drawn the limits to which the employer must submit when regulating religious symbols in the workplace. The aim of the paper is to summarize precisely these limits that the employer derives from the decisions and to which it must submit when restricting religious symbols in the workplace.
