Selected Aspects of Trademark Reform within the EU and their Projection to the Trademark Act

Abstract:

Tato diplomová práce se zabývá vybranými aspekty reformy práva ochranných známek, a to jak na úrovni práva unijního, tak na úrovni českého práva. Cílem této práce je především analyzovat reformní změny ve smyslu judikatury Soudního dvora. Ve vztahu k promítnutí do českého zákona se práce zaměřuje zejména na vybrané aspekty reformy, a to na grafickou znázornitelnost ochranné známky, relativní důvody zápisné nezpůsobilosti ochranné známky, tranzit zboží označeného ochrannou známkou, práva vlastníka ochranné známky a výjimky z těchto práv a prokazování užívání starší známky. Práce rovněž nastiňuje i další aspekty reformy, tedy certifikační ochranné známky, administrativní změny nebo absolutní důvody zápisné nezpůsobilosti.

Abstract:

This diploma thesis deals with selected aspects of the reform of Trademark law, both at the level of EU law and at the level of Czech law. The aim of this thesis is to analyse the reform changes in the sense of the case law of the Court of Justice of the European Union. In relation to the projection to the Czech Trademark Act, the thesis focuses mainly on selected aspects of the reform, namely the graphical representation of a trademark, relative grounds for refusal of trademark, transit of goods bearing the trademark, rights conferred by trademark and limitations, and the proof of genuine use of the trademark. The thesis also outlines other aspects of the reform, in particular the certification marks, administrative changes, and absolute grounds for refusal.
