Abstract:

Předmětem této práce je analýza vývoje interrupční politiky a jejího sociálního a poli-tického kontextu v USA, a to na národní úrovni a ve státech New York a Alabama, jakožto představitelů dvou rozdílných přístupů k otázce interrupcí. Práce sleduje vývoj právní úpravy a s ohledem na skutečnost, že právní úprava nemusí být jedi-nou překážkou dostupnosti interrupcí, také dalších dvou aspektů – financování a počtu zařízení provádějících interrupce – které mají vliv na skutečnou možnost žen realizovat právo podstoupit interrupci. Cílem této práce je poukázat na rozdíly v pří-stupnosti interrupcí ve dvou srovnávaných státech v klíčových momentech vývoje této problematiky a za současné situace, tedy poté co prošla interrupční politika zá-sadní změnou, když v roce 2022 Nejvyšší soud USA zrušil téměř 50 let platný prece-dent Roe v. Wade, jímž bylo uznáno právo žen podstoupit interrupci jako základní právo chráněné na ústavněprávní úrovni.

Abstract:

This thesis analyses abortion access policy and its social and political context in the United States at national level and in the state of New York and Alabama, represent-ing two different attitudes to abortion. The thesis follows the development of legal aspect of abortion access and while recognizing that legislation is not the only obsta-cle to abortion access, the thesis addresses two other major aspects – funding and number of facilities providing abortion – which both impact a woman’s ability to ex-ercise her right to choose abortion. The aim of the thesis is to point out the differ-ences in abortion access in the two compared states during critical moments of abor-tion policy development in the US and the current situation, after abortion policy has undergone a major change when almost 50 years old precedent Roe v. Wade, recog-nizing women’s right to choose abortion as their constitutionally protected right, was overruled in 2022.
