Confirming of Debts According to the New Civil Code
Abstract:
Diplomová práce se zabývá tématem utvrzením dluhů podle nového občanského zákoníku. Koncepčně vymezuje pojem utvrzení dluhů. Stěžejním bodem práce je analýza institutů smluvní pokuty a uznání dluhu, a to s ústřední pozorností věnovanou úpravě těchto institutů v občanském zákoníku, obchodním zákoníku a novém občanském zákoníku, samostatná kapitola je věnována porovnání těchto úprav.
Abstract:
The diploma thesis deals with the topic of confirming of debts according to the new civil code. Conceptually defines notion of confirming of debts. A crucial point of this work is the analysis of contractual penalty and acknowledgment of debt with main attention to regulation of these institutes in civil code, commercial code and new civil code, separate chapter is dedicated to comparing of these regulations …more
