Psychological Aspects of Interrogation of Children

Abstract:

Tématem diplomové práce jsou psychologické aspekty výslechu dětí. Práce je rozdělena na teoretickou a praktickou část. Teoretická část obsahuje šest kapitol. V první kapitole jsou vysvětleny základní pojmy, jako jsou například dítě, mládež, mladistvý, výslech. Druhá kapitola se zabývá postavením dítěte ve společnosti z pohledu historie a práva dítěte. Další kapitola je zaměřena na obecný popis výslechu. Jsou zde zahrnuty například druhy výslechu, příprava nebo taktika výslechu. Ve čtvrté kapitole je popsána právní úprava výslechu dětí. Následující kapitolu jsem zaměřila na psychologické aspekty výslechu dětí, což je v této práci stěžejní. Zde hraje velkou roli věk dítěte a sugestibilita. Popisuji zde i nejčastější příčiny dětské lži a jak správně s dítětem komunikovat. Poslední a neméně důležitá kapitola nese název Postup a taktika při výslechu dětí. Sem patří taktické zásady, kladení otázek, popis výslechové místnosti, názorné pomůcky, ale také dokumentace výslechu. Praktická část zahrnuje kvalitativní výzkum. V první části se zaměřuji na analýzu rozhovorů s vyškoleným zaměstnancem PČR. Ten mě informoval o problematice výslechové praxe u dětí. V druhé části praktické části jsem vypracovala čtyři kazuistiky. V příloze jsou uvedeny další dvě kazuistiky, které jsem použila již do své bakalářské práce, a také mnou vyfotografované snímky speciální výslechové místnosti a demonstračních loutek.

Abstract:

The topic of my thesis is Psychological Aspects of Interrogation of Children. This thesis is divided into theoretical and practical parts. The theoretical part consists of six chapters. In the first chapter, basic concepts, such as "child", "youth", "youthful" and "interrogation", are explained. The second chapter describes a child´s position in society throughout history, including the rights of a child. The next chapter is focused on the general description of the interrogation. It includes possible types of interrogation, preparation and interrogation tactics. The fourth chapter describes the legal regulations of interrogation of children. The fifth chapter is aimed on the psychological aspects of the questioning of children, which is the key issue in this thesis. This is where the child`s age and their suggestibility plays a major role. Here i describe the most common reasons for why and when children lie and how to properly communicate with them. The last, but no less important chapter bears the title “The procedure and tactics in children interrogation”. This includes tactical principles, asking the right questions, description of the interrogation room, illustrative aids, but also documentation of the interrogation. The practical part includes qualitative research. In the first part i focus on an interview with a experienced employee of the Czech Republic Police. He informed me of possible issues of interrogation practices regarding children. The second part further contains four case reports. Attached are further two more case reports already published in my bachelors thesis and photographs i took of the special interrogation room and puppets.
