Abstract:

Tato práce se zabývá fenoménem de facto států. Díky slabosti mezinárodního práva a  nejasnému ukotvení některých principu v  rámci tohoto systému vznikají entity, které sice splnily kritéria státnosti, nicméně nezískaly mezinárodní uznání, a  tudíž se nestaly součástí normativního světa plně suverenních států. Jedním z  takovýchto útvarů je Somaliland, který v  roce 1991 vyhlásil svou nezávislost, avšak do dnešního dne nebyl uznán. Na jeho příkladě je analyzována problematika vzniku a  existence těchto neuznaných entit z  pohledu mezinárodněprávní teorie, ale také jejich faktická existence v  prostředí mezinárodního společenství. V prvních kapitolách jsou představeny pojmy a  koncepty jako právo národů na sebeurčení, secese, mezinárodní uznání a  Peggovo pojetí de facto státu, jež vytváří teoretický rámec pro následující případovou studii a  slouží k přiblížení změn a  faktorů, které zapříčinily vznik fenoménu de facto státnosti. Druhá část se věnuje problematice Somalilandu. Její součástí je popis historického pozadí vývoje této entity, ale zejména analýza vzniku Somalilandu z  pohledu mezinárodního práva, jeho postavení v mezinárodním společenství, jeho vztahů s  aktéry mezinárodního systému a  postoje mezinárodního společenství k  jeho požadavkům na uznání. V závěru je poté nastíněn také možný vývoj a  řešení v  širším kontextu celého Somálska.

Abstract:

This project deals with the phenomenon of the de facto states. Due to the weakness of international law and unclear establishment of some priciples within this system, there are entities which, despite having fulfilled the criteria of statehood, have not gained the international recognition, and that is why they have not become part of the nominative world of fully sovereign states. One of these states is Somaliland which declared independence in 1991, however, it has not still been recognized so far. The problems of establishment and existence of some of these unrecognized entities have been analysed from the international-law-theory point of view in the case of Somaliland, as well as their real existence in the international community environment. In the first chapters, the terms and concepts such as right of self-determination of people, secession, international recognition and Pegg´s conception of the de facto state are introduced, and they create the theoretical frame for the following case study and serve to bring nearer changes and factors that have caused the phenomenon of the de facto states. The other part deals with the problems of Somaliland. It includes development of this entity, but mainly the analysis of its development from the international community, its relationships to the participants of the international system and attitudes of the international community towards the demands for its recognition. In conclusion, there is a draft of a possible development and solution in a broader context of whole Somalia.
