Statutory aspects in public real estate disposal process

Abstract:

Z hlediska obsahu jednotlivých kapitol je práce rozdělena do tří tematických okruhů. První okruh se zaměřuje na analýzu obecných zásad při hospodaření s obecním majetkem, zveřejňování záměru obce a problematiku ceny v místě a čase obvyklé, tedy materii obsaženou zejména v ustanoveních § 38, 39 a 41 obecního zřízení. Druhý okruh tematicky navazuje utvářením vůle v orgánech obce a jejím projevem navenek včetně vztahů a rozložení pravomocí mezi jednotlivými orgány, tedy materii obsaženou zejména v ustanoveních § 84, 85, 102 a 103 obecního zřízení. Třetí část se odchyluje od přímého výkonu majetkových práv orgány obce a zaměřuje se na některé otázky spojené se zprostředkovaným hospodařením s nemovitým majetkem obce, zejména organizačními složkami a příspěvkovými organizacemi. První dva okruhy intenzivně pracují se soudní judikaturou a připravovanou novelou obecního zřízení, třetí okruh poukazuje na podstatná úskalí současné právní úpravy správy a hospodaření s majetkem obce podle zákona č. 250/2000 Sb., o rozpočtových pravidlech územních rozpočtů, které se nepodařilo odstranit ani poslední významnou novelou zákona v roce 2009. Dílčí závěry formulované v rámci těchto okruhů jsou ve vzájemných souvislostech syntetizovány v závěrečné kapitole. Vzhledem k tématu práce se práce významně věnuje aktuálnímu legislativnímu procesu, který na základě vládního zadání iniciovalo Ministerstvo vnitra. Návrh novely zákona o obcích byl schválen vládou a v lednu 2013předložen k projednání Poslanecké sněmovně. Označován je také jako protikorupční, neboť principiálně naplňuje cíle identifikované ve Strategii vlády v boji proti korupci na období let 2011 a 2012. Ty mimo jiné směřují k přijetí nových preventivních a transparentních legislativních opatření v oblasti nakládání s majetkem územních samospráv, jejichž nedodržení bude explicitně sankcionováno. Navrhovaná právní úprava je v příslušných kapitolách analyzována a srovnávána s pozitivní právní normou. Syntézou rozborů právní úpravy de lege lata a de lege ferenda budou formulovány závěry o přínosu navrhované normy, popřípadě doporučení, která by měl zákonodárce při přijímání nové normy ještě zvážit. V rámci práce také dochází ke komparaci se zahraniční právní úpravou, a to Slovenskou.

Abstract:

The theme of the thesis – Statutory aspects in public real estate disposal process – was chosen due to author's service for local authorities at municipal level. Municipalities are basic territorial self-government units in the Czech Republic. As an autonomous community of citizens at particular grounds, they have been equipped with right to property on one hand and responsibility of managing it on the other. Although municipality acts as a legal person in legal relationships on its own, its management is entrusted to its elective bodies, which are constituted at local poll. Legal status of municipalities in handling property process is based on equal quality to other legal subjects; however there is a wide range of restrictions and imperatives according to law, which provide protection from public estate misuse. The thesis is concerned with municipal real estate management, because serious public property damages may occur in this particular field of science, no matter if caused by inconsiderate decision by local authorities or, even worse, by calculated actions pointed to affect damage. The thesis is divided into several thematic sections. Each section includes academic background, current practice of courts and a comparison with an amendment currently discussed in the lower house of parliament. In order to encourage the deficiency of contemporary legal arrangements and in order to bring apparent transparency and preventive measures to public real estate disposal process, the amendment was prepared under Ministry of the Interior jurisdiction. Its goal is to bring more efficient preventive rules and new methods of damage enforcement as well as relocation of competences among the local authorities (assembly and council). Particular passages of the amendment related to the topic will be subject to analysis with impact on comparison between current regulation and suggested changes. All benefits and disadvantages will be settled. First chapter provides legal and historical background for the entire topic. The Czech Constitution guarantees the right to self-government and the other legal acts are constituted on this basis, especially the Municipal Act no. 128/2000 Coll. The chapter primarily describes how these acts have developed (mostly) since 1990. An extensive topic will be widely discussed in the second part of the thesis. From basic principals which need to be met by managing the municipal real estate in common, thesis moves to legal elements specific just for municipalities. The most significant of them is the notification of intention to handle public real estate in order to reach that every potential market gets a chance to stand for communal assets. It is also mandatory that municipalities trade its property at current price according to time and location, unless an important reason to agree on lower price exists. Practical experience realized a great number of miscalculations in these specific domains, which caused damage despite the fact that The Supreme Court of the Czech Republic issued a whole range of crucial decisions in order to reduce the number of mistakes made by municipalities in the process of real estate handling. Also the Ministry of the Interior provides guidelines to avoid law violation. However, in case the law is broken, legal actions are subject to invalidity and local representatives are liable for damage. Although it is municipality's duty to recover harm done, it does not happen practically very often. It is usually because the authority which set up the loss on one hand is entitled to enforce it on the other. Also this topic will be discussed in this dominant part of the thesis. The competences within public real estate disposal are entirely distributed between municipal assembly and municipal council (if established). matter will held its place it the third chapter. Partially, the thesis focuses on corporate bodies established by local municipalities in order to achieve the role which they should provide for theirs citizens. Especially management of real estate by these legal entities will be analyzed.
