Rapid expropriation and slow restitution History of restitution processes after World War II. with a focus on the Jewish minority

Abstract:

Vyvlastňování, konfiskování majetku a následné restituce je komplexní a dlouhotrvající proces, který ovlivňuje českou společnost po desítky let od konce druhé světové války. Diplomová práce sleduje tento komplikovaný jev se zaměřením na židovskou menšinu. Právě židé byli nejvíce postiženou skupinou, kterým byl zabaven majetek nacisty, mnohdy ten stejný majetek zestátněn komunisty, a i v současnosti existují případy, kdy jim právní rámec České republiky znemožňuje získání vlastnických práv k majetku, který patřil jejich rodinám. Diplomová práce se též zabývá, jakým způsobem se stát vypořádává se svou minulostí a jak postupuje, aby byly vyrovnány majetko-právní křivdy z minulosti prostřednictvím vydávání restitučních zákonů, vznikem nadací a organizací, které se zabývají převodem majetku v době holocaustu.

Abstract:

Expropriation, confiscation of property and subsequent restitution is a complex and lengthy process that has affected Czech society for decades since the end of the Second World War. This thesis traces this complicated phenomenon with a focus on the Jewish minority. It was the Jewish community who was the most affected group, having their property confiscated by the Nazis, often the same property nationalized by the Communists, and even today, there are cases where the legal framework of the Czech Republic prevents them from obtaining property rights to property that belonged to their families. The thesis also examines how the state deals with its past and how it proceeds to settle the property-rights injustices of the past through the issuance of restitution laws, the creation of foundations and organizations that deal with the transfer of property during the Holocaust.
