Selection of Judges in the Czech Republic

Abstract:

V této práci popisuji systém výběru soudců v České republice. V první části práce předepisuji historický vývoj výběru soudců a následně přistupuji k současnému právnímu rámci, ve kterém se výběr soudců pohybuje. Nejde však pouze o výběr soudců v tom nejužším smyslu slova, nýbrž o výchovu budoucích soudců a postup, jak se stát soudcem v České republice. Právní rámec a pravidla v něm stanovená nejsou všeobjímající, proto v jedné z kapitol popisuji praktické problémy vznikající při výběru soudců. Nechybí ani úvaha nad tím, jaký by měl soudce být a co od soudce očekáváme. Inspiraci a možnosti výběru soudců je možné hledat v zahraničí. V rámci této práce tak zazní také systém výběru soudců ve vybraných zemích. Na závěr vymezuji problémy, se kterými se při výběru soudců lze setkat a navrhuji možná řešení.

Abstract:

In this thesis I describe the system of judicial selection in the Czech Republic. In the first part of this thesis I outline the historical development of the selection of judges and then I approach the current legal framework in which the selection of judges is carried out. However, this thesis is not only about the selection of judges “sensu stricto”, but also about the education of the future judges and the process of becoming a judge in the Czech Republic. The legal framework and the rules laid down in it are not all-encompassing, so in one of the chapters I describe the practical problems arising in the judicial selection. There is also reflection of what a judge should be and what we expect from a judge. Inspiration and possibilities for the selection of judges can be sought abroad and the system of selecting judges in selected countries is discussed. At the end, I try to identify all the problems that can be encountered during the selection of judges and propose their solutions.
