Selected aspects of circumstances excluding illegality

Abstract:

Tato diplomová práce je zaměřena na okolnosti vylučující protiprávnost upravené v právním řádě České republiky, s důrazem na institut nutné obrany a myšlenky spojené s principem "můj dům, můj hrad". Okolnosti vylučující protiprávnost, jako instituty trestního práva, vylučují trestní odpovědnost za předpokladu splnění zákonem stanovených podmínek. V úvodních částech autor analyzuje základní okolnosti vylučující protiprávnost - krajní nouze, nutná obrana, svolení poškozeného, přípustné riziko a oprávněné použití zbraně - vymezuje jejich základní podmínky a představuje jejich historický vývoj. V dalších částech se zabývá úpravou práva na sebeobranu v USA, kterou také komparuje s českou úpravou institutu nutné obrany. Autor v závěrečné části reaguje na snahy o začlenění principu "můj dům, můj hrad" do právního řádu České republiky a pomocí úvah "de lege ferenda" navrhuje úpravy příslušné legislativy, čímž vyjadřuje svůj postoj k možným změnám současné právní úpravy.

Abstract:

This thesis is focused on the circumstances precluding illegality in the Czech legal system, with the emphasis on the institute of the legitimate defense and the ideas of the castle doctrine. The circumstances excluding illegality, such as the institute of criminal law, exclude criminal liability if the Criminal Code conditions are complied. In the introductory parts, the author analyzes the basic circumstances excluding illegality - distress, legitimate defense, permission of the aggrieved party, admissible risk and legitimate use of weapon - defines their basic conditions and presents their historical development. In the following sections, the author deals with the regulations of self-defense in the USA, which are also compared with the Czech institutes of legitimate defense. In the final part, the author responds to the efforts of incorporating the principles of castle doctrine into the legal order code of the Czech Republic and uses "de lege ferenda" considerations to propose amendments to this issue.
