Divisibility of a Thing – Integral Part of a Thing

Abstract:

Cílem této práce je zmapování vývoje úpravy dělitelnosti věci a součásti věci od jejich historických základů v římském právu až po úpravu v novém občanském zákoníku. Rovněž je cílem této práce nabídnout nekonvenční pohled na součást věci, která ne vždy musí tvořit skladebný prvek věci složené, fyzicky spojený s touto věcí. V práci se zabývám otázkou pojetí součásti věci v právním smyslu a podmínkami, které součást věci určují, přičemž zdůrazňuji, že pro charakteristiku součásti věci je významné zejména spojení funkční. Dále se v práci zabývám otázkou vymezení věci v právním smyslu, kategorizací věcí na hmotné a nehmotné, na movité a nemovité a rovněž zásadou superficies solo cedit. V práci se také zabývám institutem příslušenství věci. Přínosem této práce by mělo být upozornění na problémy související s posuzováním součásti věci a dělitelnosti věci a to jak za současného právního stavu, tak v souvislosti s přijetím nového občanského zákoníku. Tato práce by rovněž měla nabídnout alternativní pohled na pojetí součásti věci v právním smyslu.

Abstract:

The aim of this thesis is to map the development of legal regulation of divisibility of things and parts of things from their historical roots in the Roman law up to the new civil code. Also, this thesis should offer an unconventional view of a part of a thing, which does not always have to form a component element of a composite thing, physically connected to such thing. The thesis deals with the concept of a part of a thing in legal sense and it also deals with conditions of the definition of a part of a thing. I emphasized that from the legal point of view the functional connection is more significant for the assessment of a part of a thing. The thesis also deals with the definition of a thing in a legal sense, the categorization of things into tangibles and intangibles, movables and immovables things and also with the principle of superficies solo cedit. The thesis also deals with the institute of accessories to a thing. The benefit of this thesis should be to point out the problems related to the assessment of a part of a thing and divisibility of things, both under the current legal system and in relation to the adoption of the new civil code. This thesis should also offer an alternative view of the concept of a part of a thing in legal sense.
