The phenomenon of piracy - Horn of Africa

Abstract:

Tématem této bakalářské práce je "Účast Evropské unie v boji proti námořnímu pirátství v oblasti Afrického rohu." Hlavním cílem této práce je analyzovat zločin námořního pirátství, a to především s ohledem na účast Evropské unie při jeho řešení. Nárůst pirátství v tomto regionu může být vysledován do počátku vypuknutí občanské války v devadesátých letech. V té době se v Somálsku zhroutil režim Siada Barreho, což vytvořilo mocenské vakuum, které se rozhodly využít zahraniční společnosti. Ty zde začaly nelegálně rybařit a vytvářet skládky toxického odpadu. To mělo za následek devastaci místního ekosystému a odebrání obživy pro mnoho obyvatel Somálska. Kombinace pokračující občanské války a problematická politická situace zde zapříčinily humanitární krizi. Teoretická část práce se zaměřuje na vývoj námořního pirátství, taktiky pirátů a mezinárodní právo. Důraz v této části práce je kladen na definici pirátství a trestání pirátů dle Úmluvy OSN o mořském právu (UNCLOS). Druhá část práce se zabývá analýzou námořního pirátství v oblasti Afrického rohu. V této části práce analyzuji vývoj somálského pirátství, ty nejsilnější a také nejznámější pirátské gangy a ekonomický model místního pirátství. Pirátství v tomto regionu je do jisté míry specifické, jelikož místní piráti se především zaměřují na braní rukojmích. Zcizení plavidla nebo jeho nákladu pro ně není prioritou. Třetí a závěrečná část práce se zaměřuje na participaci Evropské unie v boji proti somálskému pirátství. Kvůli zmírnění humanitární krize Evropská unie spustila misi EU NAVFOR Somalia na ochranu dodávek Světového potravinového programu (WFP). Pro zvýšení svého zapojení následovaly mise EUCAP Nestor a EU Training Mission Somalia. Prozatím se zdá, že pirátství v tomto regionu končí. Nicméně stále musí být vyřešena situace uvnitř Somálska samotného, aby tak mohlo dojít k vytvoření trvajícího a udržitelného řešení.

Abstract:

The topic of this bachelor thesis is "The participation of the European union in the fight against maritime piracy in the Horn of Africa". The main aim is to analyze the crime of maritime piracy, especially with regard to the involvement of the European Union. The rise of maritime piracy in this region can be traced back to the beginning of the civil war in the nineties. At that time the regime of Siad Barre collapsed. This created a power vacuum which was used by foreign companies. The companies started fishing illegally in the region and dumping of toxic waste soon followed. These actions devastated local enviroment and left many people with no means to survive. The combination of an ongoing civil war and a problematic political situation started a humanitarian crisis. Theoretical base of this thesis is provided by the development of maritime piracy, piracy tactics and international law. The emphasis in the theoretical part is given to the definition of piracy and to the punishment of pirates by the United Nations Convention on the Law of the Sea (UNCLOS). The second part of the thesis analyses maritime piracy in the Horn of Africa. In this part I am analyzing the development of Somali piracy, the most powerful and well known pirate gangs and the economic model of local piracy. Piracy in this region is specific in some way. Local pirates mostly focus on taking hostages. Stealing the vessel or the cargo is not their main focus. The third and the last part focuses on the participation of the European Union in the fight against local piracy. To alleviate the humanitarian crisis, the Europan Union launched the mission EU NAVFOR Somalia for the protection of humanitarian aid vessel of the World Food Programme (WFP). To further its involvment the missions named EUCAP Nestor and EU Training Mission Somalia soon followed. For now piracy in this region seems to be ending, but the situation within Somalia still needs to be dealt with to create a lasting and sustainable solution.
