Illegitimate Children in Modern Legal History

Abstract:

Tato diplomová práce se zabývá právním postavením nemanželských dětí v českém právním řádu od druhé poloviny 18. století do současnosti. Jejím cílem je analýza vývoje právní úpravy, týkající se dětí narozených mimo manželství, od návrhů v tereziánského kodexu až po současný právní řád, s důrazem na právní poměry mezi rodiči a nemanželskými dětmi, zejména na právo na výživu a výchovu a právo dědické. Součástí práce je však také nástin právní regulace veřejnoprávní péče o ohrožené děti včetně dětí nemanželských od meziválečného období až do současnosti.

Abstract:

This thesis is focused on the legal status of illegitimate children in Czech legal system from the second half of the 18th century up to now. It aims to analyse the development of the legislation regarding children who were born outside marriage, from the proposals in Codex Theresianus to the current law, focusing on the legal relations between parents and illegitimate children, especially the duties of alimentation and bringing up, and the inheritance law. However, the thesis also includes an outline of public-law regulation of social care for vulnerable children, including illegitimate ones, from the interwar period up to the present day.
