Impacts of OTC Derivates Market's Regulation in EU from 2013

Abstract:

Hlavním cílem práce je prokázat, jestli je přináší zavádění evropské regulace OTC derivátového trhu pozitivní či negativní efekt pro jeho účastníky a jestli jsou náklady spojené s využíváním centrální protistrany a se ztrátou flexibility převáženy přínosem v podobě větší stability trhu. Práce tak nejprve vymezuje pojem OTC derivát a stručně mapuju historii vzniku derivátů. Dále popisuje příčinu světové krize, zejména ve spojitosti s OTC deriváty. Práce poté ve stručnosti prochází Dodd Frankův zákon, který je obdobou evropské regulace a jehož zavádění v USA začalo oproti evropské regulaci s předstihem, a proto jsou tak jeho dopady analogicky využity ke zkoumání dopadů evropské regulace. Následně práce podrobněji prochází původní znění evropské regulace a její pozdější úpravy. Za pomoci časových řad a komparační analýzy jednotlivých kategorií OTC derivátů práce dochází k závěru, že OTC derivátový trh jako celek klesá od počátku světové krize a zavedení regulace tento trend nijak neovlivnilo. Z toho vyplývá, že přínosy regulace pro účastníky OTC derivátového trhu nepřevažují náklady s regulací spojené. Zároveň se však nepodařilo prokázat, že zavádění regulace OTC derivátového trhu je příčinou jeho poklesu. Z analýzy však jednoznačně prokazatelné, že z důvodu regulace nedochází k přesunu OTC derivátů do těch částí světa, které regulaci nepodléhají.

Abstract:

The main objective of the thesis is to proof whether the implementation of the EU regulation of OTC derivates market brings a positive or negative effect on its participants and if the related costs overweight the gained benefits. Thus, the thesis defines the term „OTC derivative“ and briefly maps the history of derivatives. It also describes the cause of the global crisis, especially in connection with OTC derivatives. Then the thesis briefly describes Dodd Frank's Act which had begun ahead of EU regulation and that is why it can be used as a reference. The thesis is then focused on EU regulation itself and its rolling modifications. By using time series and comparative analysis thesis concludes that the OTC derivates market as a whole has been declining since global crisis began. The declining trend has not been impacted by the regulation. Based on this the thesis assumes that the benefits of the regulation do not overweight the costs. On the other hand the thesis cannot proof that there is any negative impact of the regulation on OTC derivates market volume. However, the thesis proofs that OTC derivates transactions have not been significantly shifted to those parts of the world that are not subject to the regulation.
