Role of the ECJ in the area of institutional disputes (within the sphere of EU common criminal policy)

Abstract:

Tato bakalářská práce se zaměřuje na roli Evropského soudního dvora (ESD) ve sporech institucí ve sféře společné trestní politiky EU. Pracuje s hypotézou, že ESD jakožto nadnárodní instituce podporuje při řešení sporů institucí v oblasti trestního práva spíše nadnárodní instituce na úkor mezivládní Rady EU. Na úvod práce stručně vymezí pojem institucionálních sporů v EU ve sféře trestního práva. Poté přistoupí k zevrubnějšímu rozboru vybraných klíčových rozsudků ESD v této oblasti. Nakonec práce dospěje k závěru, zda skutečně platí, že ESD podporuje v předmětných sporech institucí spíše nadnárodní instituce, respektive poukáže na limity takové „podpory“ ze strany ESD.

Abstract:

This bachelor thesis focuses on the role of the European Court of Justice (ECJ) in institutional disputes within the sphere of the EU common criminal policy. It elaborates on the hypothesis that the ECJ as the supranational institution, while resolving the disputes among Union institutions, is ready to support supranational institutions to the expense of the intergovernmental Council of the EU. Firstly, the term of institutional disputes within the sphere of criminal law is briefly introduced. Thereafter, more in-depth analysis of the crucial judgements of the ECJ in this area follows. At the very, the conclusions are drawn as to whether the ECJ really supports the supranational institutions, respectively the limits of such a support from the ECJ are stressed.
