TRIPS and current issues of protection of intellectual property rights

Abstract:

Název mé diplomové práce je "TRIPS a aktuální otázky ochrany práv duševního vlastnictví". Cílem práce je zjistit, zda jsou ochrana autorských práv výrobců zvukových záznamů podle mezinárodních smluv, zejm. Dohody TRIPS, a v návaznosti ne ně jejich ochrana na základě judikatury Evropského soudního dvora, dostačující. V práci je popsána historie vzniku a vymezení jednotlivých institutů práv duševního vlastnictví. Následně je probírána ochrana autorského práva na mezinárodním úrovni, a hlavní pozornost věnována Dohodě TRIPS. V praktické části je probírána úprava autorského práva v legislativě EU a s ní související rozhodnutí Evropského Soudního dvora v oblasti ochrany autorských práv výrobců zvukových záznamů. V práci jsou používány metody rozboru významných mezinárodních smluv působících v oblasti ochrany autorských práv a analýza judikatury ESD, dále metoda historická a komparativní.

Abstract:

The topic of my diploma thesis is „TRIPS and current issues of intellectual property protection”. The aim of the thesis is to find out whether the protection of copyrights of producers of phonograms under international agreements, especially the TRIPS Agreement, and consequently not their protection on the basis of the case law of the Court of Justice of the European Union, is sufficient. The thesis describes the history of the origin and definition of individual institutes of intellectual property rights. Subsequently, copyright protection is discussed at the international level, and the main focus is on the TRIPS Agreement. The practical part discusses the regulation of copyright in EU legislation and related decisions of the European Court of Justice in the field of copyright protection of producers of phonograms. The work uses methods of analysis of important international agreements operating in the field of copyright protection and analysis of ECJ case law, as well as historical and comparative methods.
