Analyses of the Application of the CISG Concerning the International Aspect - Practical Consequences
Abstract:
Tato práce je zaměřena na jeden z aplikačních předpokladů Úmluvy - mezinárodní prvek obsažený v kupní smlouvě, který je dán dle článku 1 Úmluvy místem podnikání stran v různých zemích. První část práce pojednává o působnosti Úmluvy. Stěžejní část práce tvoří analýza aplikace Úmluvy podle článku 1 odst. 1 písm. a) a písm. b), výhrady dle článku 95 a volby práva.
Abstract:
This thesis deals with one of the application requirements – „internationality“ of the contract under Art. 1 of CISG which requires that the parties must have their places of business in different states. The first part treats of the scope of application of CISG.
