Ethics of Punishment

Abstract:

Tato práce pojednává o jedné z nejdůležitějších etických otázek, a sice otázce ospravedlnění trestání. Je zde stručně rozebrána samotná podstata trestu včetně nutnosti jeho ospravedlnění, poměrně detailně pak hlavní konkurenční teorie ospravedlňující trestání - retributivismus a konsekvencialismus. Kapitoly věnované jednotlivým konkurenčním směrům obsahují kromě obecné charakteristiky také analýzu jednotlivých dílčích teorií, včetně jejich předností a nedostatků. Součástí práce je kromě teorie také praktická část založená na anketě v oblasti trestu a jeho ospravedlnění.

Abstract:

This thesis deals with one of the most important ethical issues, namely with punishment justification. It also briefly describes the very essence of punishment including the need to justify it, then quite in detail, there are described the main competing theories justifying punishment - retributivism and consequencialism. The chapters dealing with individual competing directions also contain, besides the general characteristics, analysis of each sub-theories, including their strengths and weaknesses. Part of the thesis, next to theory, is also a practical part, based on a survey in the field of punishment and its justification.
