Practical Efect of theAapplication of the Law on Civil Service

Abstract:

Náplní diplomové práce je stručná charakteristika služebního poměru podle zákona o státní službě, jeho právní úpravy a zařazení takové úpravy do právního řádu České republiky. Tato diplomová práce pojednává o významu poměru ve státní službě, o specifikách vzhledem k základním soukromoprávním pracovním vztahům. Zaměření práce je tedy orientováno do oblasti výkonu státní služby, státních zaměstnanců v režimu zákona o státní službě. Stěžejní část práce je věnována vzniku služebního poměru (zejména pak výběrovým řízením a úřednické zkoušce). Značná část práce pojednává o platovém zařazení zaměstnance před a po vykonání úřednické zkoušky. Upozorňuji na diskriminační prvek v odměňování a zmiňuji se i o roli ombudsmana v oblasti státní služby.

Abstract:

The aim of the thesis is to briefly characterize a civil service employment relationship as defined in the Civil Service Act, the relevant legal regulations and their incorporation in the legal system of the Czech Republic. The thesis deals with the relevance of a civil service employment relationship and its specificities with regard to basic private-law employment relationships. The thesis is thus focused on the area of civil service performance and civil servants in accordance with the Civil Service Act. A significant part of the thesis is dedicated to the creation of a civil service employment relationship (especially to competitive hiring procedures, civil service exam). The most comprehensive part of the thesis is devoted to an employee´s classification in grade before and after passing the civil service exam. Attention is also drawn to the discriminatory element in remuneration. The role of the Ombudsman in the area of civil service employment relationship is mentioned as well.
