Abstract:

Zákon č. 89/2012 Sb., občanský zákoník, přináší do právního řádu České republiky řadu významných změn a novinek - jednou z nich je institut svěřenského fondu. Bakalářská práce na téma svěřenský fond je rozčleněna na čtyři části. V první části se zabývám Haagskou konvencí z roku 1985. Dále se zaměřím na antický fideikomis a jeho vývoj a také zmíním institut legatum a taktéž zde proberu anglosaský trust a jeho vývoj. V druhé části definuji pojmy jako je zakladatel svěřenského fondu, svěřenský správce, obmyšlený a také dohled. V další podkapitole definuji typy svěřenských fondů a zabývám se jejich praktickým použitím. Třetí část se zaměřuje na svěřenské fondy v České republice. V této části se zabývám historií svěřenství a také její právní úpravou. V dalších podkapitolách práce popisuji vznik svěřenského fondu, správu, plnění, dohled, změny a také jeho zánik. Taktéž se zde zaměřím na svěřenství v praxi. V poslední, tedy čtvrté části analyzuji svěřenské fondy v zahraničí. Konkrétně se jedná o německý institut svěřenství neboli Treuhand u kterého definuji dědické právo. Další podkapitolou je francouzská fiducie. Zde uvádím typy nadací. Předposlední podkapitolu tvoří institut zvaný rakouská nadace. Zde ji definuji a také rozebírám typy nadací v Rakousku. A na závěr rozebírám lucemburské fiduciární smlouvy.

Abstract:

Law no. 89/2012 Coll., of the Civil Code, brings into Czech law a number of significant changes and innovations - one of them is the institute of the Trust Fund. The thesis on trust fund is divided into four parts. The first part, deals with the Hague Convention of 1985. In addition, I focuse on the antique fideikomis and its development and I also mention the Institute Bequest and I discuss about the Anglo-Saxon trust and its development. The second part, defines terms such as the founder of a trust, the trustee appointed person and supervision.The next section, defines the types of trust funds and the dealing with their practical use. The third part, focuses on trust funds in the Czech Republic. This section deals with the history of the trust and its regulation. In further sections, the work describes the emergence of the Trust Fund, governance, compliance, supervision, and also the changes and their demise. I also focus on the trust in practice. At last, the fourth part analyzes the trust funds abroad. Specifically, the German Institute of trusts or Treuhand, in which I define the right of inheritance. Another subchapter is the French Fiducia. Here are the types of foundations. The last subchapter concerns, the institute called the Austrian Foundation.
