Non-payment Bank Guarantees in Export Financing in Selected Countries

Abstract:

Diplomová práce se zaměřuje na způsoby zajištění rizik v mezinárodním obchodě, zejména na bankovní záruku. Práce popisuje rozdílné způsoby fungování dokumentárních akreditivů, dokumentárních inkas, směnek a stand-by akreditivů, charakterizuje bankovní záruky z hlediska jejich obsahu či typu a vymezuje hlavní výhody využití bankovních záruk oproti ostatním způsobům zajištění v domácím i mezinárodním obchodování. Hlavním přínosem práce je, kromě porovnání neplatebních záruk v České republice, Německu, Indii a Egyptě z hlediska právního ukotvení v národním právním řádu, či z hlediska způsobu vystavování, především nalezení a formulace specifik týkajících se záruk v těchto zemích. Na základě provedeného srovnání jsou definována doporučení českým exportérům, kteří nemají s principem fungování bankovních záruk v uvedených zemích předchozí zkušenosti.

Abstract:

This diploma thesis focuses on the ways of hedging in International trade, particularly on the bank guarantee. The thesis describes the differencies between documentary letters of credit, documentary collections, notes and stand-by letters of credit, describes bank guarantees in terms of their content or types and identifies the main advantages of using bank guarantees compared to other ways of hedging in the domestic or in the international trade. The main contribution of this work is, in addition to comparing non-payment guarantees in the Czech Republic, Germany, India and Egypt from a legal perspective in national legislation or in terms of the ways of issuing the guarantee, to find and to define the specifics concerning guarantees in these countries. On the basis of comparison are defined recommendations for Czech exporters who do not have a prior experience with operating principle of bank guarantees in those countries.
