Death penalty in the Heian period

Abstract:

Tato práce se zaměřuje na trest smrti a jeho dočasné zrušení v éře Heian v letech 810 až 1156. Za účelem jeho vymezení je nejprve shrnuta historie trestu smrti v Japonsku. Poté jsou zkoumány události, které vedly k dočasnému zrušení trestu smrti, průběh období tohoto moratoria a nakonec incident, který vedl ke znovuzavedení poprav. Práce poté zkoumá tři hlavní faktory, které v období Heian zapříčinily pozastavení výkonů trestu smrti. Konkrétně jimi byl buddhistický nesouhlas se zabíjením, znečištění vznikající smrtí v šintó a kult pomstychtivých duchů pocházejících z lidové víry. Tito duchové vznikali kvůli nespravedlivé smrti a byla jim přičítána zodpovědnost za nejrůznější přírodní katastrofy a epidemie. Z toho důvodu se tomuto tématu věnuje další část práce, ve které je názorně ukázána síla kultu duchů na příkladu slavností gorjó-e a případu Sugawary no Mičizaneho, který se údajně stal pomstychtivým duchem gorjó poté, co zemřel ve vyhnanství. Nakonec se práce zabývá tím, jak se moratorium trestu smrti projevilo v heianské literární tvorbě.

Abstract:

The primary focus of this text is the abolishment of the death penalty in the Heian era. In order to explore this focal point, the various events and incidents that led to the abolishment of the death penalty in the Heian period are outlined. Then, the circumstances that occurred during moratorium in the Heian period along with the events that marked the reintroduction of the death penalty are explained. Furthermore, the three essential contributions that lead to the banishment of capital punishment in the Heian era are examined. They include the perception of punishment in Buddhism, the concept of pollution in Shinto, and the spirits in Japanese mythology. Special attention is given to the spirits who appear because of unjust deaths, as they are responsible for various disasters. The power of the vengeful spirits is explained through goryo-e festivals and the case of Sugawara no Michizane, who allegedly turned into a goryo spirit after his death in exile. The last chapter focuses on the literary art of the Heian era that relates to the overarching topic of the moratorium of the death penalty.
