Legal Aspects of combating International Terrorism

Anotace:

Rigorózní práce postihuje základní, resp. klíčové hmotněprávní instrumenty, které byly na poli boje s mezinárodním terorismem přijaty, hodnotí jejich význam a přínos na straně jedné a upozorňuje na hlavní nedostatky a slabiny na straně druhé. Zároveň jsou v rigorózní práci uvedeny i právní nástroje, které má pro boj s mezinárodním terorismem k dispozici Česká republika. Je hodnocena jejich úroveň z hlediska plnění mezinárodněprávních závazků. Poslední subkapitola si pak klade za cíl seznámit čtenáře s možnou koncepcí tzv. českého „protiteroristického“ zákona, který by byl postaven na nutnosti kvalitní a efektivní práce s informacemi na vnitrostátní i mezinárodní úrovni, s důrazem na stěžejní úlohu zpravodajských služeb. Právní aspekty boje proti mezinárodnímu terorismu pokrývají celou řadu problémů a otázek a velmi výrazně se dotýkají i ochrany lidských práv a svobod. Není snahou této práce pokrýt všechny její formy, neboť je tato oblast velmi rozsáhlá a tento cíl by tak nebyl ani dosažitelný. Z celého komplexu právních instrumentů se tak zaměřuji pouze na ty nejvýznamnější a zejména na ty, které byly přijaty v posledních letech, kdy vzrostlo úsilí mezinárodního společenství o revizi stávajících a vypracování nových smluv proti terorismu, popř. jiných mimosmluvních instrumentů, a to jak na regionální, tak na univerzální úrovni. To, že dosavadní dokumenty pomáhající potlačovat terorismus nejsou dokonalé a vykazují určité mezery, však bylo známo ještě před tímto klíčovým datem; září 2001 a další teroristické útoky, které po něm následovaly, snahy o vypracování dokonalejších instrumentů jen uspíšily. Státy zintensivnily společnou „přeshraniční“ snahu po hledání řešení jak těmto útokům předcházet a eliminovat je. Problematika terorismu, jehož projevy jsou spjaty s růstem politického, sociálního a ekonomického napětí jako negativního aspektu probíhající globalizace, se tak posunula do centra celosvětové „mediální“ pozornosti. V práci je nevíce pozornosti věnováno legislativním krokům Evropské unie a z toho plynoucím závazkům pro Českou republiku. Česká republika, podobně jako jiné členské státy, musela na zvýšené aktivity Evropské unie (např. Rámcové rozhodnutí Rady EU v boji proti terorismu, Rámcové rozhodnutí Rady EU o evropském zatýkacím rozkazu a postupech předávání mezi jednotlivými členskými státy a další instrumenty) a na úsilí celého mezinárodního společenství reagovat. Výsledkem je přijetí mnoha novelizací či nových zákonů, na něž je v práci upozorněno.

Abstract:

This thesis is concerned with a crime of International Terrorism and legal aspects of Counter-Terrorism. Not long ago the biggest danger for community represented threat of war and totalitarian terror. Today the situation has changed and the name of the enemy is International Terrorism. Terrorism and the act of terrorism is generally accepted as an organised action of an individual, group of persons or organisation, militantly organised, as a rule, whose aim is to raise the atmosphere of uncertainty and fear as well as safety and total destabilisation by means of rough and often drastic deterrence of population, various attacks against administrative, executive, judicial, important financial, economic and other strategic bodies, facilities, instructions and the representatives thereof. Terrorism is a threat to all states and to all people. It poses a serious threat to our security, to the values of our democratic societies and to the rights and freedoms of our citizens, especially through the indiscriminate targeting of innocent people. In response to attacks of 11th September 2001, terrorism has become the main issue that is in the centre of medial and political attention. Terrorism is a complex and still developing phenomenon. In past, terrorism was extensively used by groups of individuals belonging to identifiable organisations with defined political objectives, economical goals or social objectives. A new generation of terrorists is different, anonymous and taking no responsibility for the incidents. Places of terrorist possible attacks differ too. The trend is moving from the attacks of specific human targets to killing which does not distinguish the targets of their attack. The classical form of terrorism, small arms and bomb attacks is changing to a brand new form involving modern ammunition, mass use of conventional means, chemical, biological and radiological weapons especially against the civilian population. Consequences of such terrorist attacks may be terrific. Moreover, terrorists can easily exploit modern technologies, such as Internet, mobile phones etc., which are the products of globalization and modernization of all society. These facts make the treat of terrorist attacks more and more dangerous and actual. In this respect the combat with terrorism only at the national level is almost impossible. The need of international cooperation in combating with this specific crime is really necessary. All states should adopt appropriate legislative measures concerning this topic. Generally, there are four pillars of the Counter-Terrorism Strategy “prevent, protect, pursue, and respond”, established by European Union. This Strategy constitutes a comprehensive and proportionate response to the international terrorist threat. It requires work at national, European and international levels to reduce the threat from terrorism and our vulnerability to attack. The Strategy sets out our objectives to prevent new recruits to terrorism; better protect potential targets; pursue and investigate members of existing networks and improve our capability to respond to and manage the consequences of terrorist attacks.It needs to be said that prevention is the most important thing in the fight against terrorism – it is the key word which connects all counterterrorism instruments. These instruments are: intelligent operations investigating all relevant information about terrorists; police who seize the offenders, dispose of demolition bomb etc.; army who help to protect state territory; legislative measures which set the legal limits for the responsible authorities and set penalties for terrorists and persons who are supporting them; technological preventive measures; political activism which make effort to remove the cause of terrorism and civil defence which prepares structures reducing the consequences of the terrorist act, including surgery and support of victims.The fight against terrorism is never-ending “undeclared cruel

war”. International cooperation based on sharing respective information, exchanging experiences in fight against terrorism, developing new legal instruments and state capacity reflecting modern aspects of terrorism can help to reduce the possibility of terrorist attack.
