Penal regulation of computer crime

Abstract:

Předmětná práce se zabývá tématem počítačové kriminality, která je v dnešní době více než aktuální. Popisuje vznik dané kriminality, tj. její počátky s nástupem počítačů a informačních technologií až po současnost. Snaží se definovat, resp. popsat pojem „počítačová kriminalita“ tak, aby bylo možné si učinit obrázek o tom, čím ve skutečnosti je. Že daná problematika se netýká kriminality pouze z hlediska počítače jako takového, ale že je nutné tuto problematiku chápat ze širšího úhlu pohledu, tj. vědět, že souvislost mají i takové pojmy jako software, hardware, internet, hacker, phishing, atd. Práce stručným způsobem popisuje historický vývoj počítačové kriminality, kterou dokumentuje rychlý nárůst počítačů a technologií a s ní souběžně narůstající počítačovou kriminalitu. Práce rovněž charakterizuje pachatele (kategorie pachatelů, typy pachatelů z kriminologického hlediska) a prostředí, ve kterém se pachatel pohybuje, organizovaný zločin, oběti pachatele. V další části pak autor zmiňuje internetovou kriminalitu a nejčastější odvětví internetové kriminality, kterou se zabývá naše policie (zakázaná pornografie, extremistické projevy, zneužití platebních a obchodních systémů, porušování autorského práva, pomluvy a diskreditace osob). V další části, která je stěžejní částí této práce se autor věnuje počítačové kriminalitě a její současné trestně právní úpravě. V jednotlivých podkapitolách pak popisuje trestné činy mající vztah k datům (uloženým informacím), trestné činy, při nichž je počítač prostředkem k jejich páchání, trestné činy ve vztahu k počítači, jeho příslušenství a jiným nosičům informací jako věcem movitým a ostatní trestné činy, které mohou mít rovněž prvek výpočetní techniky. Závěrem pak autor uvádí úvahy o tom, jaké by právo ohledně počítačové kriminality mělo být s přihlédnutím k nové úpravě obsažené v dosud neschváleném rekodifikačním návrhu.

Abstract:

The subject of this work is the computer criminality which is quite a current issue. This work describes beginning of this criminality; it means its start with computers entry and information technologies, and continues up to now. It tries to define the conception of the „computer criminality“ the way that it would be possible to make a picture about what does it mean in real. This problem can not be taken only from „computer“ point of view but other subjects as software, hardware, internet, hacker, phising etc. have to be considered to that topic as well. This work is a summary of the computer criminality historical evolution. It shows how fast the computers production was as well as technologies progress and growing criminality in that field. The work defines the offender (categories of offenders/types of offenders from criminology view) and environment in which the offender is moving around - organized crime and victims as well. In the other part, there is the internet criminality and its most often segments mentioned. In this field, the police is dealing with pornography, extremist exhibition, abuse of payment & business systems, breaking of copyright, scandal and discredit of people. The main part is focused on the computer criminality and its present criminal legal regulations. Each subchapter describes different crimes. We are facing crimes connected to data (stored information); crimes where the computer is used as a criminal device; crimes connected to the computer itself, to its equipment/components and other information mediums taken as movable assets. There are also crimes where the computer and its components can be abused for. At the end, the author describes some thoughts how the law should be set in case of the computer criminality. These thoughts were made with regard to a new regulation included in yet unregistered re-codification proposal.
