Abstract:

Předkládaná diplomová práce se zabývá tématem institutu dočasné ochrany v ČR v aktuálním kontextu, a tedy věnuje náležitou pozornost dočasné ochraně jakožto velice efektivnímu a flexibilnímu nástroji mezinárodní ochrany sui generis, jehož cílem je rychle poskytnout útočiště na omezenou dobu osobám prchajícím před nebezpečím humanitární katastrofy. Cílem diplomové práce bylo provést detailní rozbor institutu dočasné ochrany, vysvětlit jeho podstatu a účel zejména skrze poměrně detailní analýzu jeho historického vývoje ve světových dějinách se zaměřením na evropský kontinent. Dalším cílem práce bylo poskytnout přehled o tom, jak je dočasná ochrana upravena v právním řádu České republiky, což se nejeví možným bez důkladného studia unijního právního rámce coby doposud jediného nadnárodního systému práva, který institut dočasné ochrany komplexně upravil. Důraz přitom je kladen na jádro této úpravy čili na směrnici Rady 2000/55/ES. Diplomová práce postupně rozebírá legislativní proces přijetí směrnice 2001/55/ES, její osobní, věcnou a časovou působnost. Kromě zmíněné směrnici diplomová práce rovněž věnuje náležitou pozornost primárnímu právu EU, zejména čl. 78 SFEU, jež je právním základem společné azylové politiky EU. Dále jsou rozebraný odpovídající prováděcí rozhodnutí Rady o aktivaci dočasné ochrany a o prodloužení doby jejího trvání. Následně diplomová práce hodnotí eurokonformitu české právní úpravy dočasné ochrany. Zvláštní pozornost je přitom věnovaná balíčků zákonů označovaných jako Lex Ukrajina, jež jsou českou reakcí na aktivaci režimu dočasné ochrany. Za účelem poskytnuti hlubšího přehledu, diplomová práce rovněž poskytuje rozbor vybraných judikátů v oblasti dočasné ochrany. Základním pramenem diplomové práce jsou příslušné právní předpisy, a to jak normativní právní akty EU, tak i České republiky a dalších členských států. Pro účely hlubší analýzy byla využita rovněž i odpovídající komentářová literatura, vybraná rozhodnutí zejména vnitrostátních soudů ČR a učebnice, které poskytly ucelený přehled o historickém vývoji institutu dočasné ochrany.

Abstract:

The present thesis deals with the topic of the institution of temporary protection in the Czech Republic in the current context, and therefore pays due attention to temporary protection as a very effective and flexible instrument of international protection sui generis, which aims to quickly provide shelter for a limited period of time to persons fleeing from the danger of humanitarian disaster. The aim of the thesis was to make a detailed analysis of the institution of temporary protection, to explain its nature and purpose, in particular through a rather detailed analysis of its historical development in world history with a focus on the European continent. Another aim of the thesis was to provide an overview of how temporary protection is regulated in the legal system of the Czech Republic, which does not seem to be possible without a thorough study of the EU legal framework as the only supranational system of law that has so far comprehensively regulated the institute of temporary protection. The emphasis is placed on the core of this regulation, i.e. Council Directive 2000/55/EC. The thesis analyses the legislative process of the adoption of Directive 2001/55/EC, its personal, material and temporal scope. In addition to the Directive, the thesis also pays due attention to primary EU law, in particular Article 78 TFEU, which is the legal basis of the EU's common asylum policy. Furthermore, the relevant Council implementing decisions on the activation of temporary protection and on the extension of its duration are discussed. Subsequently, the thesis assesses the Eurocompliance of the Czech legislation on temporary protection. Particular attention is paid to the package of laws referred to as Lex Ukraine, which are the Czech response to the activation of the temporary protection regime. In order to provide a deeper overview, the thesis also provides an analysis of selected case law in the field of temporary protection. The main source of the thesis is the relevant legislation, both EU normative legal acts and those of the Czech Republic and other Member States. For the purposes of in-depth analysis, relevant commentary literature, selected decisions of national courts of the Czech Republic in particular, and textbooks were also used to provide a comprehensive overview of the historical development of the institution of temporary protection.
