Abstract:

Je známé, že dokazování listinami (zejména veřejnými) je spojené s uplatňováním právních a skutkových domněnek mimořádného významu pro účinnou ochranu subjektivních práv. Ovšem ani mezi renomovanými autory nepanuje shoda o jejich povaze a významu pro alokaci důkazního břemena v civilním soudním sporu. Tato práce se zabývá pojmem a klasifikací listiny s přihlédnutím k listinám sporné povahy, analyzuje právní úpravu dokazování listinami v zahraničních právních řádech a novém občanském zákoníku a poté přistupuje k řešení otázky, kterou stranu tíží důkazní břemeno při popíraní pravosti a správnosti soukromé listiny.

Abstract:

It is well-known fact that evidence provided by documents (especially the public ones) is associated with the application of legal and factual presumptions of distinct importance for effective protection of rights. However, even between the highly qualified jurists is no consensus on their nature and significance for the allocation of the burden of proof in civil dispute. In this thesis I deal with the concept and classification of records and documents taking the documents of problematic nature into account. I also provide a description and analysis of the foreign legislation on the issue as well as the one in new Czech Civil Code. At the end, the very question of which party to the dispute the burden of proof is borne by when authenticity or veracity of the document is denied is dealt with.
