Provincial Administration of Ancient Rome and its ills - from alterum non laedere to crimen peciunae repetundae

Abstract:

Téma předkládané rigorózní práce s názvem „Provinční správa starověkého Říma a její nešvary – od alterum non laedaere ke crimen repetundarum“ je náhledem do dvou spolu velmi úzce souvisejích oblastí antického římského práva veřejného: provinční správy a zločinu vydírání provincií (crimen pecuniae repetundae). Tématu vydírání provincií se již věnuji od roku 2009, kdy jsem napsal, obhájil a vyhrál fakultní kolo studentské vědecké odborné činnosti (SVOČ) s prací „Od rozmařilosti k vydírání – od lex Oppia ke crimen repetundarum“. Po svém nástupu na postgraduální studium na Právnické fakultě Masarykovy univerzity do oboru Dějiny práva a římské právo jsem získal podporu na dva postgraduální specifické výzkumy: Crimen repetundarum (MUNI/A/1044/2009) a Římské trestní právo (MUNI/A/1043/2009) v jejichž rámci jsem průběžně publikoval své dílčí vědecké výsledky svého bádání. Zejména šlo o výstupy: „Repetundární zákony v neprávních pramenech“, „Ciceronova procesní taktika ve Verrově případu – hanba soudcům, kteří by nechtěli vynést rozsudek“, ve spoluautorství s JUDr. Renatou Veselou, Ph.D. „Princip neslučitelnosti úřadů podle římské jurisprudence v kontextu současného pojetí inkompatibility“. Ve Velké Británii mi vyšly dvě studie a názvem „Roman provinces – from alterum non leadere to Lex Calpurnia“ a „Leges de repetundis“. Vzhledem k průběžným publikovaným výsledkům jsem se rozhodl materii repetundárního zákonodárství a vývoje provinční správy antického Říma spojit do jedné studie – předkládané rigorózní práce – v níž jsem si stanovit tyto dvě pracovní teze: 1. existence či neexistence římského správního práva 2. termín provincie – je označením pro úkol magistrátů nebo územní jednotka Ve 3. století př. n. l. došlo ke sjednocení Itálie pod římskou moc. Římané rozšířili svou moc i do jižní části Itálie a v roce 276 př. n. l. si podmanili řecké město Rhégia. Tímto se Římané dostali na pobřeží, ze kterého již měli na dosah ruky Sicílii – první provincii (získaná v roce 241 př. n. l.). Sicílie byla velmi bohatým ostrovem. Východní část ostrova byla pod nadvládou řeckých městských států (nejvýznamnější Syrakusy). Ve východní části ostrova mělo od konce 5. stol. př. n. l., několik osad Kartágo. Sicílie měla velmi výhodnou strategickou polohu. Tuto strategickou polohu si uvědomovali jak Římané tak i Kartaginci. Z bojů mezi Syrakusami a Messanou se rozpoutala tzv. první punská válka. Jejím průběhem se nebudeme zabývat, z pohledu této práce je důležitý její výsledek. Kartágo bylo poraženo, mělo zakázáno posílat své lodě do italských vod, deset let muselo platit Římu vysoké válečné reparace (odškodné) a muselo se stáhnout ze Sicílie, kterou Římané zabrali, s výjimkou Syrakus a několik dalších měst, která stála na římské straně. Takto získal Řím svou první provincii. m získal se stávala nedílnou součástí římské obce – civitas. Zcela odlišný postup zavedli Římané při správě území, která se nacházela mimo Itálii. Pro tato území se začal používat termín provincie. Tento termín – provincia – původně označoval funkci či poslání svěřené úředníkovi národa římského – veliteli vojska. Od roku 227 př. n. l se tak označuje oblast ležící mimo Itálii, která je spravována úředníkem. Pojem provincie původně neoznačoval geograficky pevně stanovené a ohraničené území, nýbrž sloužilo k určení územní působnosti úředníka, který tam vykonával své imperium. Každá provincie dostala svůj zvláštní statut (postavení) a svou, dnes můžeme říci, provinční ústavu – lex provinciae . Tento zákon upravoval hlavní otázky správní, pozemkové a soudní. Římané při vypracovávání této provinční ústavy vycházeli z podmínek, které v dané provincii panovaly. Např. na Sicílii převzali syrakuský daňový systém, který zavedl krále Hieron II. tento systém zavedl přímé daně (poplatky) ve výši jedné desetiny úrody. Druhým aspektem rigorózní práce je crimen repetundarum – zločin vydírání, kterého se mohl dopustit úředník národa římského při výkonu úřední moci v provincii, šlo především vyžadování „úplatků“ a přivlastňování si různých věci, především uměleckých. Plný název tohoto zločinu je crimen pecuniae repetundae – vrácení zločinem získaného majetku. Základem slova repetundae je slovo repetere což znamená žádat nazpět, řečtí spisovatelé někdy používají pro termín repetundae δίκη δώρων . Dalším slovem je pecuniae což jsou jednak peníze, ale také všechno, co má nějakou hodnotu . Posledním pojmem je crimen, což je označení pro veřejnoprávní jednání, které je stíháno v iudicium publicum. Výsledkem těchto tří slov je crimen pecuniae repetundarum – nebo-li zločin vydírání provincií jejich správci. Repetundárního zločinu se v nejstarší době mohl dopustit jen úředník národa římského při výkonu úřední moci v provincii. Šlo především o vyžadování „úplatků“ a přivlastňování si různých věci, především uměleckých. Trestem bylo, jak napovídá samotný název zločinu – repetundae – vrácení zločinem získaného majetku. Později se skutkové podstaty rozšiřovaly a slovo repetundae se používalo k vyjádření nedovoleného jednání, které mělo být odškodněno, např. repetundarum insimulari, damnari . Zločinu vydírání se v pozdější době mohl dopustit např. i soudce, který přijal úplatek za to, že vynese určitý rozsudek , nebo i přijetí více jak 10.000 sesterciů za obhajobu. Repetudnární zločin byl upraven v těchto následujících zákonech: - lex Calpurnia de pecuniis repetundis z roku 149 př. n. l., - lex Acilia de repetundis z roku 123 – 122 př. n .l., - lex Servilia repetundarum krátce před rokem 111 př.n.l. , - lex Cornelia de repetundis z roku 81 př. n. l., - lex Iulia pecuniis repetundis z roku 59 př. n. l., - rogatio Pompeia de repetundis z roku 55. př. n. l., - SC Calvisianum z roku 4 př. n. l. - Edikt Oktaviána Augusta z roku 4 př. n. l. - Theodosiánův kodex - Tria volumina císaře Justinána (Corpus iuris civilis). Rigorózní práce sleduje několik časových období. Prvním časovým obdobím je polovina 8. století př. n. l., kdy dochází ke vzniku římského (státního) pozemkového vlastnictví. V tomto období došlo k legendárnímu založení Věčného města a začíná se řešit právní otázka pravomoci nad určitým územím. Druhé sledované období je období od roku 241 př. n. l., kdy Řím získává první mimoitalské území – Sicílii – a začíná vznikat a vyvíjet se právní úprava regulující postavení „podřízeného“ území a jeho obyvatelstva. Třetí období je, Theodorem Mommsenem nazvaný, principát. V tomto období dochází ke vzniku velkého, mírového, územního imperia císaře Augusta. Období literárního působení Livia, Tacita a Suetonia. Čtvrté období je období vrcholného a pozdního principátu – období literárního působení Appiána. Rigorózní práce se zabývá problematikou římského trestního práva, dále státního zřízení a práva administrativního. Pro pochopení římského práva, nejen římského, ale jakéhokoli, je důležité pochopit dobu ve které platilo a to nejen společenské poměry, hospodářskou situaci, ale hlavně smýšlení lidí a jejich chování. Tyto informace můžeme získat jednak z tzv. právních pramenů, ale především z tzv. narativních pramenů (neprávních pramenů práva). Předmětem této rigorozní práce je římská provinční správa a její nešvary, základními prameny budou jednotlivé zákony (leges de repetundis), „základní zákony“ provincií např. lex Hieronica, ale především římská historiografie: díla Cicerona, Livia, Tacita, Appiana, Suetonia či Plinia mladšího. Na těchto dílech byla provedena deskripce relevantních pasáží, které budou srovnány s dostupným poznáním formálních právních pramenů. Na právních pramenech byla, vzhledem k oboru rigorozní práce, provedena základní pracovní metoda právní romanistiky – exegese (exegesis). Iuris praecepta sunt haec: honeste vivere, alterum non laedere, suum cuique tribuere v této sentenci převzaté do Digest císaře Justiniana definovalo římské právo základní příkazy práva. Nejdůležitější je druhý příkaz alterum non leadere; příkaz nikoho nepoškozovat je výše vyjádřen v pasáži z Livius Ab Urbe condita XLII, 1, kde se stal součástí římské provinční politiky, která však selhala a vedla k přijímání repetundárních zákonů, které stíhaly nepoctivé správce provincie. Prvním zákonem byl lex Calpurnia, přijatý v roce 149 př. n. l. Repetundární zákony jsou důležitým pramenem poznání života ve starověkém Římě. Tyto zákony jsou pramenem poznání jak formálních pramenů práva, tak i tzv. materiálních pramenů práva. Na jednotlivých zákonech jejichž rozboru je věnován tento příspěvek je ukázán vývoj právní úpravy jednoho zločinu, ale také společenské poměry, které vyvolaly tuto legislativní smršť.

Abstract:

Theme of the submitted rigorous thesis titled “The provincial administration of Ancient Rome and its maladies” – from alterum non laedaere to crimen repentudarum” is a view into the two closely related areas of Ancient Roman public law: the provincial administration and the crime of extortion of provinces (crimen pecuniae repetundae). I have devoted to the topic of extortion of provinces already since 2009, when I wrote, defended and won faculty round of competition the Student's Science and Expert Research (SVOČ) with the work “From the profligacy to extortion - from lex Oppia to crimen repetundarum.“ Since my commencement of postgraduate studies at the Faculty of Law of the Masaryk University in the field of History of Law and Roman law, I gained support for two postgraduate specific researches: Crimen repetundarum (MUNI/A/1044/2009) and The Roman criminal law (MUNI/A/1043/2009), where I continuously published particular scientific results of my researches. There were especially these outputs: "Repetundarum laws in non-legal sources", "Cicero's procedural tactic in the case of Verro - shame of judges, who would not want to pronounce a verdict", in co-authorship with JUDr. Renata Veselá, Ph.D. "The principle of incompatibility of offices in accordance with the Roman jurisprudence in the context of the current concept of incompatibility." I issued two studies in the United Kingdom titled "Roman provinces - from alterum non leadere to Lex Calpurnia," and "Leges de repetundis". On account of the continuous published results, I decided to join the subject matter of repetundarum legislation and development of the provincial administration of Ancient Rome into one study – the submitted rigorous thesis – in which I set these two theses: 1. The existence or absence of Roman administrative law 2. The term of the province - is the title for task of municipal authority or territorial unit Repetundae Pecuniae in its widest sense was the term used to designate such sums of money as the Socii of the Roman State or individuals claimed to recover from magistratus, Judices, or Publici Curatores, which they had improperly taken or received in the Provinciae, or in the Urbs Roma, either in the discharge of their Jurisdictio, or in their capacity of Judices, or in respect of any other public function. Sometimes the word Repetundae was used to express the illegal act for which compensation was sought, as in the phrase "Repetundarum insimulari, damnari;" and Pecuniae meant not only money, but anything that had value. The expression which the Greek writers sometimes use for Repetundae is δίκη δώρων . During the royal period, crimen repetundarum could have been committed only by the administrator of Roman nation while he exercised official authority in the province. These were mainly the cases of asking for the “bribe” and appropriation of various things, especially objects of art. The punishment consisted of (as the appellation of the crime itself—repetundae—suggests) return of acquitted property. Originally, it was not even possible to appeal to comitia because it was the return a property that had been unfairly acquitted from the inhabitants of the province that was considered to be the goal of the decision. Later the facts of the cases were supplemented, and a word repetundae was used as a reference to the prohibited acts that should be compensated. Crimen repetundarum could be, in the later periods, committed also by a judge that accepted a bribe to pronounce a particular verdict or a lawyer that accepted more than 10.000 HS for the pleading. In the third century B.C., Italy was united under the Roman power. Romans extended their influence also to the south part of Italy, and in 276 B.C. conquered the Greek town Rhégia. With this, Romans got to the seaside, which was just a little way from Sicily, a very prosperous island at the time. The eastern part of the island was governed by Greek city states (the most

remarkable was Syracuse). From the end of 5th century B.C. onwards Carthage had a few settlements in this eastern part of the island. Sicily had a very favourable strategic position in this regard and both Romans and Carthaginians were conscious of this. Battles between Syracuse and Messana lead to the so called First Punic War. The course of this war will not be discussed as only the result is important for this article. Carthage was defeated and was prohibited to send their boats to the Italian sea. In addition, Carthaginians had to pay reparation to Romans for the following ten years, and they had to retreat from Sicily that was then governed by Romans, with exception of Syracuse and some other cities standing on the Roman side. By this act, Rome acquitted its first province. Roman provinces from 241 B.C. to 30 B.C.: - 241 B.C. – Sicily - 238 B.C. – Corsica and Sardinia - 203 B.C. – Cisalpine Gallia (in 42 jointed with Italy) - 197 B.C. – Hispania Citerior and Ulterior - 167 B.C. – Illyria - 148 B.C. – Macedonia - 146 B.C. – Africa - 129 B.C. – Asia - 121 B.C. – Transalpine Gallia - 74 B.C. – Bithynia - 74 B.C. – Crete and Cyrenaica - 64 B.C. – Cilicia - 64 B.C. – Syria - 59 B.C. – Cyprus - 51 B.C. – Gallia (divided in 22 B.C.) - 30 B.C. – Egypt was a personal property of Octavian Augustus and administrated by special vicegerent with title praefectus Augustalis Romans had to solve the question of administration with the acquisition of the first province. Italian territory that Rome acquitted became an integral part of Roman civitas. A different procedure was introduced while administering territories outside Italy. For these territories, an appellation “province” started to be used. Provincia in Latin originally determined a function or mission entrusted to an official of Roman nation – army commander. From 227 B.C. it also expressed a territory outside Italy that was administrated by an official. A term province originally did not mean geographically fixed and determined territory, but it represented a territorial scope of an official who exercised his imperium. Every province received its own special statute and its-as we say nowadays-province’s constitution - lex provinciae. This legislation regulated the main questions concerning administration, property and courts. Romans worked with the local conditions of the province while drawing up the constitution. For example in Sicily, they accepted Syracuse’s tax system that was introduced by king Hieron II. This system was based on a direct taxes (fees) equalling the amount of one tenth of the harvest. The second aspect of the rigorous thesis is crimen repetundarum – the crime of extortion, which could have been committed by officer of Roman nation during exercise of the official authority in the province, there was primarily demanding of "bribes" and appropriation of various things, especially the artistic ones. Full title of this crime is crimen pecuniae repetundae – return by the crime of acquired property. The base of word repetundae is a word repetere, which means to claim back, Greek writers use sometimes δίκη δώρων for the term repetundae. Another word is pecuniae, which means partly money, but also everything that has some value. The last term is crimen, which is the designation for a public-law action, which is being prosecuted in the iudicium publicum. The result of these three words is crimen pecuniae repetundarum - or that is the crime of extortion of provinces by their administrators. The repetundarum crime could have been committed in the oldest ages only by the officer of Roman nation when exercising his official authority in the province. There was primarily demanding of "bribes" and appropriation of various things, especially the artistic ones. The punishment was, as the title of the crime itself indicates- repetundae – return by the crime of acquired property. Later, the facts of the case expanded and the word repetundae was being used to express the illegal acting that should have been recompensed, e.g. repetundarum insimulari, damnari. The crime of extortion could have been at a later time committed e.g. also by judge, who accepted a bribe to pronounce a certain verdict , or even also acceptance of more than 10,000 HS for the pleading. Roman penal law did not have unified regulation of material and procedural law. Moreover, Roman law did not know a single law that we nowadays call “the penal code.” Particular crimes were regulated by special laws that included both material and procedural rules. These laws were then linked in the so called groups of laws dealing with certain crime. In case of crimen repetundarum, the group consisted of the following laws: 1. lex Calpurnia de pecuniis repetundis dated 149 B.C., 2. lex Iunia de repetundis probably dated 126 B.C., 3. lex Acilia de repetundis dated 123 – 122 B.C., 4. lex Servilia repetundarum dated 100 – 111 B.C., 5. lex Cornelia de repetundis dated 81 B.C., 6. lex Iulia pecuniis repetundis dated 59 B.C., 7. rogatio Pompeia de repetundis dated 55. B.C., 8. SC Calvisianum dated 4 B.C. 9. Codex Theodosianus 10. Tria volumina Lex Calpurnia de pecuniis repetundis This first Lex that prosecuted unfair province administrators was proposed by tribun plebis Lucius Calpurnius Piso Frugi. The punishment consisted of return of acquitted property, which is why these proceedings were not subject to ius provocationis. This Lex did not use exile as a punishment just yet. Lex Calpurnia de pecuniis repetundis created a special commission that acted in the proceedings regarding crimen repetundarum. This commission was designated as questiones repetundarum (perpetuae), and it prosecuted bribery of inhabitants in provinces. The province inhabitants were treated as foreigners – peregrines, that is why the trial was administered by praetor peregrinus. Literature describing lex Calpurnia de pecuniis repetundis: - Marcus Tullius Cicero De officiis libri tres II. 21 - Marcus Tullius Cicero Brutus, 27, 106 - Gaius Institutiones IV, 19 Lex Iunia de repetundis The Lex Junia was passed probably about B.C. 126 on the proposal of M. Junius Pennus, Tribunus Plebis. It is probable that this was the Lex under which C. Cato, Proconsul of Macedonia, was living in exile at Tarraco (Cicero Pro Balbo 11; Vell. Pat. II. 8); for at least exsilium was not a penalty imposed by the Calpurnia Lex, but was added by some later Lex. This Lex Junia and the Lex Calpurnia are mentioned in the Lex Servilia. Lex Acilia de repetundis The Lex Acilia, which seems to be of uncertain date (probably B.C. 101), was proposed and carried by M' Acilius Glabrio, a Tribunus Plebis, which enacted that there should be neither ampliatio nor comperendinatio. It is conjectured that this is the Lex Caecilia mentioned by Valerius Maximus (VI. 9. 10.) in which passage if the conjecture is correct, we should read Acilia for Caecilia (Cic. in Verr. Act. i.17, in Verr. I.9). It has sometimes been doubted whether the Acilia or Servilia was first enacted, but it appears that the Acilia took away the comperendinatio which the Servilia allowed. Lex Servilia repetundarum The Lex Servilia Glauca was proposed and carried by C. Servilius Glauca, Praetor B.C. 100. This Lex applied to any magistratus who had improperly taken or received money from any private person; but a magistratus could not be accused during the term of office. The Lex enacted that the Praetor Peregrinus should annually appoint 450 judices for the trial of this offence: the judices were not to be senators. The penalties of the Lex were pecuniary and exsilium; the law allowed a comperendinatio (Cic. in Verr. I.9). Before the Lex Servilia, the pecuniary penalty was simple restitution of what had been wrongfully taken; this Lex seems to have raised the penalty to double the amount of what had been wrongfully taken; and subsequently it was made quadruple. Exsilium was only the punishment in case a man did not abide his trial, but withdrew from Rome (Savigny, Von dem Schutz der Mind., Zeitschrift, x.). Under this Lex were tried M' Aquillius, P. Rutilius, M. Scaurus, and Q. Metellus Numidicus. The Lex gave the Civitas to any person on whose complaint a person was convicted of Repetundae (Cic. pro Balbo, 23, 24). Lex Cornelia de repetundis Lex Cornelia de repetundis - was proposed by Lucius Cornelius Sulla. This Lex passed in 81 B.C. and it is supposedly the penultimate republican legislation of crimen repetundarum. Lex Cornelia extended the scope of facts of the case of extortion to all unlawful acts committed by magistrates of Roman nation as opposed to only those committed provinces. The term bribery newly comprised also of, for example, acceptation of bribes by judges. Praetor presiding this quaestio selected the judges from the list of senators by a lot. In this instance, this Lex derogated parts of lex Serviliae – an exclusive right to judge crimen repetundarum was returned to senators. Lex Cornelia de repetundis addressed also comperendinatio (already treated in lex Serviliae). In the penal procedure, comperendinatio meant the division of procedure into actio prima and actio secuunda - that is a division of penal procedure to two sessions (suspension of a trial). During the first session– actio prima - the prosecutor presented the accusatory speech, and he described what the accused is charged with. The advocate then had the same time to present his case. After the speeches, there was a demonstration of proofs: examination of witnesses, presentation of documents etc. After speeches and proofs, the action in court was interrupted, and the next session was called for the third day after, at which time the sentence was pronounced. Most likely, the speeches (action and advocate) nowadays known as closing speeches—were presented one more time before the proclamation of the sentence. The original judicial proceedings according to lex Acilia had only one session, so the defense and proofs were heard only once, and the whole case was decides in uno contextu, proclamation of sentence included. The above mentioned division was also subject to a complaint of one active participant of the process - Marcus Tullius Cicero. Cicero referred to the practice enacted by lex Acilia. According to legis Corneliae, sanctions were financial (litis aestimatio) and aquae et ignis interdictio. The following magistrates were condemned on the basis of this Lex: L. Dolabella, Cn. Piso, C. Verres, C. Macer, M. Fonteius, and L. Flaccus. Cicero was an advocate of the last two administrators. Lex Iulia pecuniis repetundis The last Lex de Repetundis was the Lex Julia passed in the first consulship of C. Julius Caesar B.C. 59 (Cic. In vat. 12). This Lex consisted of numerous heads (capita) which have been collected by Sigonius (Cicero Ad Fam. VIII. 8). This Lex repealed the penalty of exsilium, but in addition to the litis aestimatio, it enacted that persons convicted under this Lex should lose their rank, and be disqualified from being witnesses, judices, or senators. This is the Lex which was commented on by the Jurists, whose expositions are preserved in the Digest (48. tit. 11), and in the Code (9. tit. 27). This Lex adopted some provisions that existed in previous Leges, as for instance that by which the money that had been improperly retained could be recovered from those into whose hands it could be traced (Cic. pro C. Rabir. Post. 4). The Lex had been passed when Cicero made his oration against Piso, B.C. 55 (in Pis. 21). A. Gabinius was convicted under this Lex. Many of its provisions may be collected from the oration of Cicero against Piso. Cicero boasts that in his proconsulship of Cilicia there was no cost caused to the people by himself, his legati, quaestor, nor anyone else; he did not even demand from the people what the Lex (Julia) allowed him (ad Att. V.16). Rogatio Pompeia de repetundis – proposed by Gnaeus Pompeius Magnus. This proposal of a Lex was not enacted. It is described for example by Cicero in Pro Rabiria Postuma 6, 13. SC Calvisianum – this senatusconsultum simplified the procedure dealing with crimen repetundarum so that only a group of five senators ruled on the matter. Punishments for the bribery in provinces changed with the gravity of these unlawful acts and with the time passing. Originally the sanction consisted of the return of money acquitted by the crime, later even of the return of twice to four times as much as the unjustly acquired sum of money. In the case of the most serious crimes, a punishment consisted of exiilium and the „accessory punishment“ meant a loss of capacity to be an official. The unfair administrator was deleted of album iudicium, and he was also excluded from the senate. The rigorous work pursues several periods of time. The first period is half of the eighth century B.C., when the Roman (state) land ownership was established. In this period, there became also the legendary founding of the Eternal City and the legal question of jurisdiction over a certain territory was being solved. The second pursued period is the period from the year 241 B.C., when Rome acquired the first territory out of Italy – Sicily - and the legislation regulating the status of the "subordinated" territory and its population began to form and develop. The third period is, as called by Theodor Mommsen, the Principate. In this period, there was formed the large, peaceful, territorial empire of Emperor Augustus. The period of literary activities of Livy, Tacitus and Suetonius. The fourth period is period of the High and Late Principate - the period of literary activity of Appian. The rigorous work deals with the issue of Roman criminal law, also the state system and administrative law. To understand Roman law, and not only Roman law, but even any law, it is necessary to comprehend the time, in which it was being applied, namely not only the social relations, economic situation, but primarily the mentality of people and their behavior. We can find this information partly in the so-called legal sources, but primarily in the so-called narrative sources (non-legal sources of law). The subject of this rigorous work is Roman provincial administration and its maladies, the fundamental sources will be the particular legal acts (leges de repetundis), the "basic acts" of the provinces such as e.g. lex Hieronica, but primarily the Roman historiography: the writings of Cicero, Livy, Tacitus, Appian, Suetonius or Pliny the Younger. On these works, there was performed a description of the relevant passages, which would be compared with the available knowledge of formal legal sources. The legal sources were, on account of the field of the rigorous work, subjects of the basic working method of legal Roman Law Studies - exegese (exegesis).
