The Principle of Complementarity at the ICC: The Case Study of Kenya and Libya

Abstract:

Tato diplomová práce se zabývá aplikací principu komplementarity v situacích Keni a Libye. Tato řízení jsou aktuálně projednávána Mezinárodním trestním soudem. Jedná se o první případy, kdy přípustnost řízení před ICC napadl stát. Cílem práce je zanalyzovat rozhodnutí v těchto řízeních o přípustnosti se zaměřením na test stejné osoby/stejného jednání. Test vznikl v rozhodovací praxi Soudu a používá se pro posouzení, zda stát vyšetřuje stejnou věc jako ICC. V keňských řízeních bylo potvrzeno, že stát musí vyšetřovat totožnou osobu jako je vyšetřována u ICC. V libyjském řízení bylo řečeno, že domácí řízení musí zahrnovat v zásadě stejné jednání jako řízení před ICC. Vše musí být podloženo důkazy o dostatečném stupni konkrétnosti s dostatečnou důkazní hodnotou. V průběhu práce jsou kriticky hodnoceny argumenty Soudu. V závěru je vyjádřen názor, že Soud svým výkladem stanovuje vysoký práh pro napadení přípustnosti a některé otázky zůstávají stále nezodpovězeny.

Abstract:

This thesis deals with the application of the principle of complementarity in situation in Kenya and situation in Libya. These situations are currently before the International Criminal Court. These are the first cases where the admissibility was challenged by the States. The aim of the thesis is to analyse the decision in these admissibility challenges focusing on the same person/same conduct test. The test was developed during the judicial practice of the Court and it helps to identify if the State investigates the same case on national level. In Kenyan cases, the Court decided that the State had to investigate exactly the same person as the ICC. In Libyan case, the Court said that the national investigation had to encompass substantially the same conduct as the ICC investigation. All the statements have to be proved by the evidence with a sufficient degree of specificity and probative value. In the thesis, the arguments of the Court are critically assessed. In conclusion, it is expressed the view that the Court sets the high threshold for the challenge of the admissibility and several issues still remain unanswered.
