Legal Aspects of Additional Structures Licensing from the Perspective of Practice

Abstract:

Cílem mé diplomové práce bude nastínění, zhodnocení a návrh řešení problematiky dodatečného povolování staveb z pohledu praxe, a to s ohledem na rozhodovací praxi prvoinstančního a odvolacího orgánu a rozhodovací praxe soudu, který má vliv na výklad právních norem. Dále se zaměřím na hledisko žadatele – stavebníka a pohledu z hlediska pověřeného správního orgánu. Uvedu základní problém z hlediska uplatňování (aplikací) veřejného zájmu (dle ust. § 132 stavebního zákona) při zjišťování a vymáhání dodržování stavebního zákona s ohledem na platný stavební zákon a rozhodovací praxi. Uvedu základní úskalí při postupu správních orgánů s ohledem na vymahatelnost příslušných ustanovení, s ohledem na běh lhůt, kdy některé nemají právních účinků pro stavebníka z důvodů jejich nedodržování a tím dochází k nejednoznačným postupům a možným průtahům v řízeních. Uvedu běžný postup při dodatečném povolování staveb, jak z hlediska postupu stavebníka, tak z hlediska postupu dotčeného správního orgánu. Stavebník je obecně ve výhodnějším postavení nežli správní orgán z důvodů „nedokonalého“ znění stavebního zákona, resp. jeho vymahatelnosti v praxi. Dochází k obrácenému rozložení sil, kdy je správní orgán v méně výhodným postavení nežli žadatel i když správní orgán jedná, nebo by měl jednat ve veřejném zájmu a měl by mít vrchnostenské postavení vůči žadateli - stavebníkovi. Uvedu právní aspekty dodatečného povolování stavby z hlediska samotné stavby a stavebníka. Uvedu úskalí při nesplnění výzvy správního orgánu na doplnění dokladů ze strany stavebníka a požadavek nadřízeného orgánu pro vydávání meritorního rozhodnutí ve věci oproti usnesení o zastavení řízení dle správního řádu. Vše výše uvedené uvedu na příkladech soudních rozhodnutí a vzorových příkladů z vlastní praxe při výkonu správní činnosti na stavebním úřadě (prvoinstančním orgánu) a při výkonu zastupování žadatelů (stavebníků). Uvedu vzorové jednání se stavebními úřady a jejich mnohdy „rozdílném“ postupu ve věci, a tím rozdílnému výkladu jedné právní normy – stavebního zákona. Dále uvedu pár důležitých rozhodnutí soudu, které vysvětlí a upřesní výklad dané problematiky a může být i oporou při rozhodovací praxi správních úřadů a také při podáních vůči správnímu orgánu.

Abstract:

The aim of my thesis is to outline, assess and suggest solution in case of dealing with additional building permit in practical terms, with regard to decision-making practice of first instance and the appellate body and decision-making practice of the court, which affects the interpretation of legal standards. Furthermore, I will focus on the aspect of the applicant - the builder and explain the viewpoint of the delegated administrative authority. I will present the basic problem in terms of public interests (in accordance with Article 132 of the Building Act) in the detection and enforcement of the Building Act with respect to the applicable Building Law and decision-making practice. I also introduce the basic pitfalls in the procedure of administrative bodies with regard to the enforcement of the relevant provisions, with regard to time limits, which some of them do not have legal effects for the Builder because of their non-compliance, which leads to ambiguous procedures and possible delays in the proceedings. Furthermore I will give an example of a common procedure for the additional building permit, both in terms of steps taken by a builder, and in terms of the process of the concerned administrative authority. The builder is generally in a more advantageous position than the administration because of the Building Act "vague" wording, or its enforceability in practice. There is a reverse correlation of forces when the administration is in a less advantageous position than the applicant even if the administration acts or should act in the public interest and should have superior status to the applicant - the Builder. I will introduce legal aspects of the additional building permit in terms of the building itself and the builder. I will focus on the problems arising from not meeting the requirements of the administrative body to complete the documents by the builder and not meeting the requirement of a superior authority necessary to issue a meritory decision in the case against the decision to halt proceedings pursuant to the Administrative Procedure Code. All of the above will be illustrated by the examples of judicial decisions and examples from my own experience while working for the Building Authority (body of first instance) doing administrative work and while representing the applicants (builders). I will introduce example of negotiations with the building authorities and their often "different" procedure in the matter, thus diverging interpretations of the same legal standard - the Building Act. Furthermore I will introduce some important court decisions that will clarify and specify the issue interpretation and may even be helpful for making-decision practice of administrative bodies and in submissions to the administrative authority.
