Local Self-Government and its European Aspects

Abstract:

Pro svou diplomovou práci jsem si vybral téma, jenž z mého pohledu tvoří nesmírně dynamickou oblast státní správy, obzvláště pak v posledních necelých dvaceti letech zažívá obrovský rozmach a to zejména v souvislosti se vstupem České republiky do Evropské unie.Hlavním cílem mé diplomové práce je podat co možná nejkomplexnější a nejsrozumitelnější pohled na oblast místní samosprávy a jejích evropských aspektů. Jelikož se jedná o oblast značně rozmanitou a ve své podstatě „rozdrobenou“ do mnoha dokumentů, nebyla tato práce jednoduchá co se vyhledávání informací týče. Při psaní své práce jsem se snažil o to, abych veškeré relevantní informace čerpal z co nejširšího spektra zdrojů. V mé práci tudíž zazněli citace jak z odborné literatury, tak i z odborných periodik, internetových portálů, sbírky zákonů a judikatury. Celou práci jsem rozčlenil do čtyř kapitol. V první kapitole pojednávám o základech místní samosprávy jako takové. Ve druhé kapitole se zabývám charakteristikou územní samosprávy v České republice. V této kapitole je postupně pojednáno o tom, jak funguje samospráva v ČR, na jakých zákonných základech je zakotvena a jak fungují elementární subjekty územní samosprávy, jimiž jsou obce a kraje. V následující, tedy třetí, kapitole se zabývám územní samosprávou v evropském kontextu. Tato kapitola je z hlediska mé práce nejobsáhlejší a má primárně poskytnout čtenáři co nejobsáhlejší a nejucelenější pohled na českou územní samosprávu, jenž je ovlivněna podstatnými a relevantními skutečnostmi jenž vyplývají ze členství České republiky v Radě Evropy a Evropské unii. V poslední, čtvrté kapitole se zabývám poznatky a trendy, jenž ovlivňují územní samosprávu, a jsou jakýmsi pomyslným logickým vyústěním současných společenských a hospodářských trendů a to z toho důvodu, že si myslím, že budoucnost, a zvláště ta u samosprávy nesmí zůstat opomenuta, věnoval jsem dostatečný prostor i určitému nastínění budoucího rozvoje místní a regionální samosprávy, jejího směřování a trendy a to vše z mého subjektivního pohledu, jak si myslím že se tato oblast bude ubírat v dalších dekádách.

Abstract:

The main purpose of my diploma thesis is to analyze and characterize self-government authority in the Czech Republic with the relationship with the European aspect. My work is divided into several parts. In the first part I would like to the readers get familiar with the fundamentals of self-government authority, its divisions and characteristics. I would like everybody to have a basic knowledge and understanding of the material what I am going to cover. Since this work is quite complicated and highly specialized I tried to explain my best in the first chapter. In the next chapter I cover the characteristics of self-government authority and its purpose in the Czech Republic. The readers can learn more about the act of self-government authority and its constitution provided by law and the importance of for a democratic state. The students can further learn more about its principles. I cover the individual organs of the self-government authority and what kind of power and characteristic they have. I also mention organization such as Federation of Municipalities and Cities, or Federation of Local Authorities of the Czech Republic. Regional Constitution is also very important thing to talk about. After mentioning the principles of it, the readers are going to have a better knowledge and understanding. An extremely important topic to talk about is revision of public administration in 2000. With the establishment of VÚSC (Czech shortcut for the regions) there will not be any gaps in the self-government authority and between the parliament and the local authorities and the same thing with villages and government. This did not help with the effectiveness of the self-government authority. Another topic I talk about, are the European aspects that have an influence on the self-government authority. It is necessary to discuss and characterize an effect of the Council of Europe on the authority formation in the Czech Republic. Our country actually has kept its membership in the Council of Europe and its committees and also other organization for a long time. After that I pay a close attention to a very precious document which is European Charter of Local Government. I describe this document in details and mention its effect on the self-government of the Czech Republic. It is almost the most famous document of Council of Europe in the region of local self-government. I also mention and deeply characterize another well-known document of Council of Europe, which is European Charter of regional self- government. This document has not been approved yet. I also write about international cooperation of region, forming Microregions and etc. Another very important point of my work is mentioning of the principal of subsidiary which is the elements of the European territorial self-government. There is also a description of territorial units’ unification in the European Union from the statistical point of view, also called NUTS. This chapter could be considered as the most important part of my diploma work. In the last and final chapter, I mention the future development of Local and Regional self-government and the directions of its trends. It also shows this dilemma as a very dynamic and fast developmental part of public administration and the administrative law itself. I write there also about the influences which they have on the new electronic and communication on the self-government, which is for example internet. They provide easier communication between citizens and the self-government. I also bring out often mentioned international treaty, also called treaty of Lisbon which is mentioning the relationship EU with the self-government.
