Options of enterprise restructuring in Slovakia

Abstract:

Bachelor thesis pays attention to the possibilities of business restructuring in the Slovak Republic. The main objective of this work is a detailed analysis of the Act no .7/2005, Act bankruptcy and restructuring and on amendments to certain laws, as amended, in particular the analysis of the third part of the analysis devoted Restructuring Act. The first chapter focuses on restructuring legislation in the Slovak Republic and the characteristics of the restructuring. The second chapter is focused on the different stages of restructuring. The third chapter of this paper pays attention to restructuring proceedings in the Slovak Republic, including a review of restructuring proceedings in the period under review and restructuring proceedings under the various district courts in the Slovak Republic in the period , including a comparison of the Institute of bankruptcy and restructuring in order to demonstrate justification to rescue the company and sense its continuation in operating activities of the enterpris . The last chapter points to evaluate possible alternatives and draws attention to the recommendations into practice.

Abstract:

Predkladaná bakalárska práca venuje pozornosť možnostiam reštrukturalizácie podnikov v Slovenskej republike. Cieľom práce je podrobná analýza a rozbor zákona č. 7/2005 Z.z., zákona o konkurze a reštrukturalizácii a o zmene a doplnení niektorých zákonov v znení neskorších predpisov, predovšetkým analýza tretej časti analyzovaného zákona venovaného reštrukturalizácii. Prvá kapitola práce je zameraná na právnu úpravu reštrukturalizácie v Slovenskej republike a charakteristiku pojmu reštrukturalizácie. Druhá kapitola práce je zameraná na jednotlivé fázy reštrukturalizácie. Tretia kapitola predkladanej práce venuje pozornosť reštrukturalizačným konaniam v Slovenskej republike, vrátane prehľadu reštrukturalizačných konaní v sledovanom období a prehľadu reštrukturalizačných konaní podľa jednotlivých okresných súdov v Slovenskej republike v sledovanom období vrátane porovnania inštitútu konkurzu a reštrukturalizácie s cieľom preukázať opodstatnenie záchrany spoločnosti a zmysel jej ďalšieho pokračovania v činnosti prevádzkovania podniku. Posledná kapitola poukazuje na zhodnotenie možných alternatív a sústreďuje pozornosť na odporúčania do praxe.
