Abstract:
Diplomová práce se zabývá trestným činem znásilnění podle zákona č. 40/2009 Sb., trestního zákoníku. Úvodní kapitoly se věnují rozboru tohoto pojmu jak z pohledu práva, tak i medicíny a právní úpravě reflektující tento pojem v průběhu dějin. Stěžejní kapitoly práce se věnují řízení o tomto trestném činu společně s jeho specifiky a zvláštnostmi a obětem znásilnění. Dále je zde k nalezení srovnání právní …more
Abstract:
The thesis is concerned about rape as a sexual offense according to act n. 40/2009 Coll., the criminal code. At the beginning of thesis is analyzed the term of rape and its legislation in czech law. Main chapters of thesis are devoted to crime proceeding and victims and their rights. One of the chapters contains the comparison of the rape legislation of another european country.
