Administrative Penal Procedure

Abstract:

Práce pojednává o vybraných institutech správního trestání, u nichž dochází k prolínání zásad trestního práva do správního práva. V první části je popsána problematika rozdělování trestních a správních deliktů a postavení právních zásad v právním řádu, přičemž v druhé části je popsán institut nutné obrany, společenské nebezpečnosti a zahlazování vždy v režimu trestního a správního práva a jsou uvedeny příklady z praxe v podobě vybraných judikatur Nejvyššího správního soudu.

Abstract:

The work deals with chosen institutes of administrative punishment, in which case the principles of a criminal law penetrate into an administrative law. The first part describes the issue of the distribution of criminal and administrative offenses and the position of legal principles in law, while the second part describes the institution of necessary defence, social dangerousness, deletion of conviction in criminal and administrative regime, and provides examples of practice in the form of chosen judicatures published by Supreme administrative Court.
