The role and competencies of the president of the Czech republic

Abstract:

V této bakalářské práci se snažím především přiblížit postavení prezidenta v ústavním systému České republiky. Je rozdělena na pět základních částí. V první části popisuji ustanovení prezidenta do funkce, problematiku a ústavní změny ve volbě prezidenta v České republice, a diskuze o přímé volbě prezidenta na Slovensku. V druhé části popisuji konec funkčního období prezidenta České a Slovenské republiky. V třetí části rozebírám práva a pravomoci prezidenta ČR a SR, vztah prezidentů obou států k moci zákonodárné a výkonné. Současně přibližuji proces legislativní moci v souvislosti s výkonem moci prezidenta republiky. Dále kontrasignaci pravomocí prezidenta, a jeho odpovědnost. Také rozebírám sestavení české vlády po volbách roku 2006. Uvádím vztah prezidenta k moci soudní a ústavním zákonům, prezidentské milosti. V čtvrté a páté části jsou definovány ostatní pravomoci prezidenta.

Abstract:

In this bachelor work I try to approach the role and competencies of Czech president in constitutional system in the Czech Republic. This work is divided to five basic parts. In the first part I describe appointment of our president to his function, questions and constitution changes in voting president in Czech Republic, and discussion about direct voting of the president of Slovak republic. In the second part I describe ending of term of office president of Czech and Slovak republic. In the third part I describe role and competencies of Czech and Slovak republic, relation of both presidents toward legislative and executive power. At the same time I describe process in legislative power in relation with function power of the president of republic. There are countersignature of competencies of president and his liability too. I analyze formation of Czech cabinet in 2006. I feature relation of president to judicial authority, constitutional lows, president´s amnesty. In the fourth and fifth part are defined other president´s competencies.
