Abstract:

Proces uzavírání vnějších mezinárodních smluv odpovídá specifikům Evropského společenství jako mezinárodní organizace. Pro mezinárodní právo nemá povaha Společenství a jeho práva zvláštní právní účinky, Evropské společenství vystupuje jako mezinárodní organizace bez ohledu na povahu svého vnitřního uspořádání. Stěžejním problémem, kterým se v práci věnuji, je rozdělení kompetencí mezi ES a členské státy a důsledky, které má nadnárodní postavení ES vůči právním řádům členských států. Klasická mezinárodní organizace nemá pravomoc zavazovat jí uzavřenými mezinárodními smlouvami členské státy. Vnější mezinárodní smlouvy ES jsou pro členské státy závazné i přes jejich možný nesouhlas (viz hlasování kvalifikovanou většinou v Radě). Pravomoci Společenství uzavírat mezinárodní smlouvy by proto měly být v zakládajících smlouvách řádně vymezeny. Tak tomu však není, proto docházelo k mnoha sporům týkajícím se dělby pravomocí mezi Společenství a členské státy. Členské státy se přikláněly k výkladu, že pokud smlouva výslovně nepřiznává Společenství pravomoc smlouvu uzavřít, taková pravomoc neexistuje. Evropský soudní dvůr se však přiklonil k teorii implicitních pravomocí, podle které je nutné posuzovat pravomoc uzavírat smlouvy z celkového smyslu Smlouvy, stejně jako jiných opatřeních přijatých orgány Společenství na základě ustanovení Smlouvy. Pravomoci Společenství k uzavírání smluv byly judikaturou ESD významně rozšířeny na úkor pravomocí členských států. Většina pravomocí Společenství však není exkluzivní, jsou sdíleny spolu s pravomocemi členských států. Sdílené kompetence mají vliv na proces sjednávání těchto dohod – smíšených smluv, kdy Společenství a členské státy jsou povinny úzce spolupracovat. Za plnění závazků vyplývajících ze smíšených smluv vůči třetímu státu nebo mezinárodní organizaci jsou odpovědny jak Společenství, tak členské státy. Vnější mezinárodní smlouvy se stávají součástí jak komunitárního právního řádu, čímž jsou závazné i pro členské státy, stejně jako ostatní prameny práva ES, zejména mohou mít přímý účinek, tzn. stanovovat práva a povinnosti subjektům vnitrostátního práva. Jako příklad smíšených dohod jsou v závěrečné kapitole uvedeny asociační smlouvy uzavírané Společenstvím a členskými státy se třetími státy a mezinárodními organizacemi, které zakládají spolupráci ve vymezených oblastech.

Abstract:

The objective of this diploma work is an analysis of external international agreements concluded by European Communities with third states or international organizations. The international agreement can be defined as any undertaking entered into by entities subject to international law which has binding force, whatever its formal designation. European Communities (meaning the European Community and the European Atomic energy Community) have legal personality and are capable to enter into international agreements. European Union has no legal personality and cannot bind itself according to international law. The second chapter presents basic principles of international contractual law, mostly the process of negotiating international treaties. The main rules of this process are included in the Vienna Convention on the Law of Treaties between International Organizations and States or between International Organizations signed in 1986. The third chapter examines Communities powers, especially the power to enter into international agreements. The basic principle of the attribution of powers between Communities and Member states is that Member states powers are the rule and the Communities powers are the exceptions. The Community may enjoy exclusive competence, which means that it can bind itself without any other assent of Member States. On the other hand, there are areas, where the Community shares competence with Member States. In this cases, it is necessary for both the Community and Member States become parties to the agreement. These mixed agreements have to be concluded by Community according to provisions of the EEC Treaty as well as by Member States according to their national law. The Community and the Member States have the duty of close cooperation with each other both in the negotiation and the implementation of these agreements. The process of conclusion of the international agreements by the Community is described in chapter four. It focuses on common procedure which can be found in Article 300 of the EEC Treaty. The Commission has the right to make recommendation to the Council, which shall authorize the Commission to open the negotiations. The agreements are concluded by the Council, which shall act mostly by a qualified majority. The Council shall act unanimously when the agreement covers a field for which unanimity is required for the adoption of internal rules and for the association agreements. The European Parliament is consulted, in some cases the assent is demanded. The European Court of Justice might be asked for giving the opinion about the compatibility of the agreement with the Treaty. There are special procedures for the EURATOM agreements and for common commercial agreements. The fifth chapter deals with legal effects of international agreements. They are bindig by international law principle pacta sunt servanda. They are also part of the Community law. The international agreements are binding on the Institutions of the Community and on the Member States. The Member States are not allowed to conclude any other agreement or accept any measures which would violate the agreement concluded by the Community. The European Court of Justice stated that some provisions in an agreement might be directly applicable when the provision contains clear and precise obligation which is not subject to the adoption of any subsequent measure. Agreements which have direct effect can impose rights and duties on individuals and national courts must apply them. There are a lot of agreements concluded by the Community within its powers, covering many areas such as common commercial policy, transport, development and assistance policy, public health etc. The last chapter points out association treaties. The Community has express power to enter into agreements with third state or international organization, which establishes an association involving reciprocal rights and obligations, common actions and special procedures. of these association agreements is to set up cooperation between the contracting parties. Some of these agreements may lead to an accession of the third state to the Community. An Agreement establishing Association between the European Economic Community and Turkey (signed on 12 September 1963) is an example of such a treaty. As the European Union has no legal personality, it cannot conclude valid international agreement with third state or international organization. The Treaty on European Union establishes political platform for cooperation between the Member States in the fields of justice and home affairs and for common foreign and security policy. The Treaty on EU contains provisions allowing conclusion of international agreements. However, these agreements must be accepted by all Member States, qualified majority is exceptional.
