Remuneration of Employee Inventions in Germany: Description of Approach and Comparative Case Study of Selected Court Decisions

Abstract:

Tato bakalářská práce se zabývá tématem zaměstnaneckých vynálezů v Německu, konkrétně metodice stanovení odměn pro vynálezce za tyto vynálezy.Teoretická část práce je věnována rešerši odborné literatury, jež byla použita k definování potřebných teoretických principů, o něž se podniky při stanovování odměn za vynálezy opírají.Praktickou část práce tvoří případová studie zaměřená na rozbor dvou soudních rozhodnutí v Německu a stanovení rozdílových faktorů, jež prokazatelně ovlivňují, a tedy mají dopad na celkovou hodnotu odměny.

Abstract:

This bachelor thesis is concerned with a topic of employee inventions in Germany, specifically the methodology of determining the remuneration of inventors for these inventions.The theoretical part of the thesis is devoted to a research of academic literature which enables to demarcate fundamental theoretical principles on which companies rely in determining the rewards for inventions.Subsequent practical part of the thesis consists of a case study focused on the analysis of two court decisions in Germany and the determination of difference factors that demonstrably affect and therefore have an impact on the overall value of the reward.
