Citizenship of Montenegro after independence in Montenegrin identity context

Abstract:

Práce se zabývá nejednoznačností udělování Černohorského občanství po roce 2006 po vzniku samostatné Černé Hory v kontextu s černohorskou identitou, která také není úplně jednoznačná.V první části práce je popsána základní charakteristika Černé Hory,dále její historie a formování černohorské národnosti. V dalších kapitolách je popsána proměna černohorského občanství od doby Jugoslávie po současnost ve srovnání s ostatními bývalými republikami Jugoslávie. Práce se soustřeďuje na problematické případy řešení občanství nového státu, které nastává u osob, které se v rámci života stěhovaly po Jugoslávii. Černá Hora je nejpřísnější v udělování státního občanství mezi bývalými jugoslávskými republikami, protože neumožňuje dvojí občanství, nicméně jsou osoby mající dvojí občanství. Ukazuje se, že současný zákon o občanství Černé Hory bude nutno změnit.

Abstract:

The thesis is about ambiguity of granting the Montenegrin citizenship after the year 2006, after the Montenegrin independence, in the context of Montenegrin identity, which is not very clear either. In the first part of thesis main characteristics of Montenegro are given by its history and the formation of Montenegrin nationality. In the following chapters the changes of Montenegrin citizenship from the times of Yugoslavia to the present are described and compared with other former Yugoslavian republics. The thesis focused on problematic cases of dealing with citizenship of the new country, which occur persons, who during their lives migrated within Yugoslavia. Montenegro is the strictest country in terms of granting citizenship to people of former Yugoslavian republics because it does not permit dual citizenship. However, there are some people with dual citizenship. It seems that the actual Montenegrin law of citizenship will have to be changed.
