Judicial officer and enforcement proceedings in current practice in the Czech Republic

Abstract:

Tato bakalářská práce je věnována charakteristice osoby soudního exekutora, tedy kdo to je, kdo soudního exekutora jmenuje do funkce, jaké předpoklady musí splňovat pro pověření exekutorským úřadem, aby mohl vykonávat nucený výkon exekučních titulů včetně zřizování exekutorského zástavního práva a další činnost dle exekučního řádu. Dále je tato bakalářská práce věnována výkonu exekučního řízení v ČR. Tedy kdo exekuci vede a na základě jakých právních předpisů, průběh exekučního řízení (od podání exekučního návrhu po skončení exekuce), způsoby provedení exekuce, účastníky řízení, zřizování exekutorského zástavního práva, další činnost exekutora, výkon rozhodnutí, náklady exekuce.

Abstract:

This bachelor thesis is devoted to the characteristics of the person of the bailiff, ie who it is who appoints a bailiff, what assumptions he has to fulfill for the commission of the bailiff to perform forced execution of executory titles, including the creation of exequatur lien and other activities according to the execution rules. Further, this bachelor thesis is devoted to the execution of the enforcement proceedings in the Czech Republic. Thus, who executes the execution and on whatbasis, the proceedings of the enforcement proceedings (from the execution of the execution proposal after the execution of the execution), the execution procedures, the parties, the establishment of the exequatur lien, the further activity of the executor, the enforcement of the decision, the costs of execution.
