Position and Rights of an Injured in the Criminal Proceedings

Abstract:

Tématem diplomové práce je postavení a práva poškozeného v trestním řízení. S tím souvisí také postavení a práva oběti trestného činu. Práce podává náhled na historický vývoj postavení a práv poškozeného v trestním řízení v Českých zemích od dob Rakouska Uherska, podrobně mapuje změny týkající se postavení a práv poškozeného v trestním řízení v zákoně č. 141/1961 Sb., o trestním řízení soudním až do současné doby a předkládá tak katalog práv poškozeného, jak se chronologicky vyvíjel v čase. Práce rovněž obsahuje přehled vývoje postavení a práv poškozeného a oběti trestného činu na mezinárodní úrovni a na úrovni Evropské unie. Samostatné kapitoly jsou věnovány zákonu č. 209/1997 Sb., o poskytnutí peněžité pomoci obětem trestné činnosti a o změně některých zákonů a zákonu č. 45/2013 Sb., o obětech trestných činů a o změně některých zákonů. Předkládá teoretické pojetí pojmů poškozený a oběť trestného činu. Poslední část práce je věnována poznatkům z osobní praxe policistky, návrhům na změny, které by v rámci Policie České republiky přispěly k lepšímu jednání s oběťmi trestných činů a návrhům de lege ferenda k zákonu č. 141/1961 Sb., o trestním řízení soudním a k zákonu č. 45/2013 Sb., o obětech trestných činů a o změně některých zákonů.

Abstract:

The diploma thesis is aimed at the position and rights of the injured party in criminal proceedings which is also connected with the position and rights of a victim of crime. The thesis provides an insight into historical development of the position and rights of the injured party in criminal proceedings in the Lands of the Bohemian Crown from the Austro-Hungarian Empire days, describes in detail any changes related to the position and rights of the injured party in criminal proceedings in the Act No. 141/1961 Coll., on Criminal Judicial Procedure, up to the present day, as well as it outlines the catalogue of rights of the injured party as developed in chronological order. The thesis also includes a development overview of the position and rights of the injured party and victim of crime at international and European levels. A separate chapters deal with the Act No. 209/1997 Coll., on the Providing of Financial Assistance to Victims of Crime and on Amendments to Certain Acts and with the Act No. 45/2013 Coll., on Victims of Crimes and on the Amendment to Some Other Acts. It deals with the concepts of injured party and victim of crime in the abstract. The final section of thesis deals with policewoman own experience, proposals to changes which could contribute to better treatment of victims of crimes from the Police of the Czech Republic, and De Lege Ferenda proposals with respect to the Act No. 141/1961 Coll., on Criminal Judicial Procedure, and the Act No. 45/2013 Coll., on Victims of Crimes and on the Amendment to Some Other Acts.
