Complaints Procedure According to CISG - Theoretical Analysis

Abstract:

The main objective of this thesis is the theoretical analysis of the complaints procedure according to the United Nations Convention on Contracts for the International Sale of Goods (CISG). The initial part deals with the application prerequisites of this Convention. The main part of this thesis focuses on the analysis of particular steps in the complaints procedure of factual defects, the thesis deals also with possibilities of mitigation of the consequences in the event of a breach of the complaints procedure. The final part is concentrated on the issues of the contractual adjustment of the complaints procedure. The thesis is supported by decisions of courts and arbitration courts.

Abstract:

Cieľom tejto práce je teoretická analýza právnej úpravy reklamačného procesu podľa Dohovoru OSN o zmluvách o medzinárodnej kúpe tovaru. Úvodná časť sa zaoberá aplikačnými predpokladmi tohto Dohovoru. Podstatnou časťou práce je rozbor jednotlivých krokov reklamačného procesu vád faktických, práca pojednáva i o možnostiach zmiernenia následkov porušenia tohto procesu. Záverečná časť je zameraná na otázky úpravy reklamačného procesu v zmluve. Práca je podporená judikatúrou obecných a rozhodcovských súdov.
