The Principle of "Superficies Solo Cedit" in Roman Law and in our Legal Reality

Abstract:

Cílem této práce je zjistit zda zásada „ Superficies solo cedit“ platila v plném rozsahu v období starého Říma, zda z této zásady již ve starém Římě neexistovaly dočasné výjimky, jak se tento princip uplatňoval v počátcích naší samostatné státnosti, zda byl uplatňován bez výhrady nebo zde opět existovala výjimka, jakým způsobem a jak se vyvinula naše současná právní praxe. Součástí práce je provést analýzu této problematiky provést porovnání uplatňování nebo neuplatňování této zásady zejména pak římskoprávní úpravy a současné právní úpravy a vyvodit závěry možného uplatnění této zásady v budoucnu ( de lege ferenda).

Abstract:

The aim of this work is to determine whether the principle of ' Superficies solo cedit "paid in full within the period of ancient Rome, whether this principle already in ancient Rome there was a temporary exemption, of how this principle applies in the early days of our separate statehood, whether it was applied without reservations or here again there is an exception, how, and how it has developed our current legal practice. Part of the work is to analyse this issue compare to the application or non-application of this principle, in particular the římskoprávní edit and the current legislation and draw conclusions on the possible application of this principle in the future (de lege ferenda).
