Tato diplomová práce pojednává o soudcovském dotváření práva. Na začátku práce je vymezen samotný pojem této práce, jak jej můžeme chápat v souvislostech. Druhá kapitola se zabývá tímto tématem z hlediska dělby moci. Dále jsou podrobně vymezeny okolnosti, které k takovému dotváření práva vedou, tedy mezery v právu a složité případy aplikace práva. This diploma thesis deals with judicial- co creating the law. At the beginning of the work is defined the concept of this work how can we understand it in context. The second chapter deals with this topic from the point of the view of the division of power.
